    Harris and Trump Embrace Tariffs

    Both Democrats and Republicans are expressing support for tariffs to protect American industry, reversing decades of trade thinking in Washington.When Donald J. Trump ran for president in 2016, there was not much love for tariffs in Washington. Many Republicans and Democrats believed that putting levies on imports created economic inefficiencies and that freer trade was the best recipe for growth.That view has largely fallen out of fashion in 2024. While Mr. Trump and Vice President Kamala Harris, the Democratic nominee, differ greatly in their campaign proposals, both of their parties are increasingly embracing tariffs as an essential tool in protecting American manufacturers from Chinese and other global competitors.It has been a sharp reversal from previous decades, when most politicians fought to lower tariffs rather than raise them. But the loss of American manufacturing jobs as a result of globalization and China’s focus on churning out cheap exports have created a bipartisan backlash against more open trade. Given that Mr. Trump’s 2016 win capitalized on such sentiments, Democrats have been striving to avoid losing voters opposed to free trade.“On economic policy and trade issues, you have both major parties moving in the same direction,” said Nick Iacovella, a senior vice president at the Coalition for a Prosperous America, which advocates tariffs and domestic investments in industry.Mr. Iacovella said that Mr. Trump would most likely go further on tariffs than Ms. Harris would, but that no matter who won the election “it’s still going to be a tariffs administration, and an industrial policy one.”Ms. Harris has sought to differentiate herself from Mr. Trump’s trade proposals, which include tariffs of 10 percent to 20 percent on most imports, as well as levies of more than 60 percent on China.     U.S. Accuses Hyundai and Two Other Companies of Using Child Labor

    The Labor Department filed a lawsuit accusing Hyundai, one of its suppliers and a staffing company of jointly employing a 13-year-old on an auto body parts assembly line in Alabama.The Labor Department on Thursday sued Hyundai over the use of child labor in Alabama, holding the car manufacturer liable for the employment of children in its supply chain, including a 13-year-old girl who worked up to 60 hours per week making car parts.In the suit, filed in a federal court in Montgomery, Ala., the department said Hyundai was responsible for the employment of children at a Smart Alabama factory in Luverne, Ala., which produces parts like body panels that are shipped to a Hyundai factory in Montgomery. The suit also claimed a staffing agency, Best Practice Service, recruited the children to work at the supplier’s plant.In a statement, Hyundai said child labor was “not consistent with the standards and values we hold ourselves to as a company.” It added that the Labor Department used “an unprecedented legal theory that would unfairly hold Hyundai accountable for the actions of its suppliers.”Smart did not immediately respond to a request for comment. Representatives of Best Practice Service, which is no longer in business, could not be reached for comment.From July 2021 to February 2022, a 13-year-old girl worked at the Smart plant, where she was recruited to work by Best Practice Service, the suit claimed. The suit also contended that two other children were employed at the plant.The Labor Department said that through the employment of children at its supplier, Hyundai was in violation of the “hot goods” provision of the Fair Labor Standards Act, which prevents the interstate commerce of goods “that were produced in violation of the minimum wage, overtime or child labor provisions” of that law.“Companies cannot escape liability by blaming suppliers or staffing companies for child labor violations when they are in fact also employers themselves,” said Seema Nanda, the Labor Department’s chief legal officer, in a statement Thursday.The suit comes after investigations by Reuters and The New York Times documented the use of child labor by the suppliers of car companies. In 2022, Reuters found that Smart Alabama had used child labor at its facility, and that Kia, which is part of the same South Korean conglomerate as Hyundai, had also used child labor in the South. A 2023 investigation by The Times found children employed at the suppliers of General Motors and Ford Motor.Hyundai imports many of its vehicles from South Korea but has made big investments in factories in the South, spending nearly $8 billion on an electric vehicle plant in Georgia.     A Loss at Mercedes-Benz Slows U.A.W.’s Southern Campaign

    After Mercedes workers voted against joining the United Automobile Workers, the union will have less momentum as it campaigns to organize Southern factories.After suffering a setback at two Mercedes-Benz plants in Alabama on Friday, the United Automobile Workers union’s efforts to organize other auto factories in the South is likely to slow and could struggle to make headway.About 56 percent of the Mercedes workers who voted rejected the U.A.W. in an election after the union chalked up two major wins this year. In April, workers at a Volkswagen plant in Tennessee voted to join the union, the first large nonunion auto plant in the South to do so. Weeks later, the union negotiated a new contract bringing significant pay and benefit improvements for its members at several North Carolina factories owned by Daimler Truck.“Losing at Mercedes is not death for the union,” said Arthur Wheaton, director of labor studies at Cornell University School of Industrial and Labor Relations. “It just means they’ll have less confidence going to the next plant. The U.A.W. is in it for the long run. I don’t think they’re going to stop just because they lost here.”Since its founding in 1935, the U.A.W. has almost exclusively represented workers employed by the three Michigan-based automakers: General Motors, Ford Motor, and Chrysler, now part of Stellantis. And it has long struggled to make headway at plants owned by foreign manufacturers, especially in Southern states where anti-union sentiment runs deep.Workers at the Volkswagen plant had voted against being represented by the U.A.W. twice by narrow margins before the recent union win there. An effort a decade ago to organize one of the Mercedes plants failed to build enough support for an election.Harley Shaiken, a professor emeritus at the University of California, Berkeley, noted that broad union organizing efforts seldom proceeded smoothly.     Mercedes-Benz Workers in Alabama Ask for Unionization Vote

    The United Automobile Workers union is mounting its most ambitious effort to gain an industry foothold beyond Detroit’s Big Three.Workers at a Mercedes-Benz factory in Alabama have petitioned federal officials to hold a vote on whether to join the United Automobile Workers, the union said on Friday, a step forward for its drive to organize workers at car factories in the South.The union is trying to build on the momentum from the contracts it won last year at Ford Motor, General Motors and Stellantis, which gave workers at the three Detroit carmakers their biggest raises in decades.The U.A.W. is also trying to organize workers at a Volkswagen factory in Tennessee and a Hyundai factory in Alabama, establishing a bigger presence in states that have drawn much of the new investment in automobile manufacturing in recent decades. A vote at the Volkswagen plant is scheduled for April 17 to 19.The drive has taken on added importance as Southern states like South Carolina and Georgia attract billions of dollars in investment in electric vehicle and battery manufacturing. The U.A.W. is trying to ensure that jobs created by electric vehicles do not pay less than jobs at traditional auto factories.A large majority of workers at the Mercedes plant, near Tuscaloosa, had earlier signed cards expressing support for a vote. On Friday they formally petitioned the National Labor Relations Board to hold an election on whether to be represented by the U.A.W., the union said.Mercedes, which makes luxury sport utility vehicles in Alabama, said in a statement that it “fully respects our team members’ choice whether to unionize” and that it would ensure that workers had “access to the information necessary to make an informed choice.”Southern states have traditionally been difficult territory for unions, in some cases because of legislation unfavorable to organized labor or because elected officials openly campaigned against unions. The lack of a strong union presence is probably one reason the region has attracted a big share of auto industry investment.Attempts in 2014 and 2019 to organize Volkswagen’s factory in Chattanooga, where the German company makes the Atlas sport utility vehicle and ID.4 electric S.U.V., failed in part because of opposition from Republican elected officials in Tennessee.Toyota, Volkswagen and other carmakers raised hourly wages after the union won pay increases for Ford, G.M. and Stellantis workers. Still, the nonunion workers tend to earn less. In many cases, pay is less of an issue than work schedules, health benefits and time off.In a video on Friday, the U.A.W. president, Shawn Fain, said workers were fighting for “work-life balance, good health care you can afford, a better life for your family.”The union has complained to the National Labor Relations Board that Mercedes has retaliated against organizers in Alabama.     As Infrastructure Money Flows, Wastewater Improvements Are Key

    The new law allocates $11.7 billion for wastewater and stormwater projects. Will it get to the impoverished communities who need it most?HAYNEVILLE, Ala. — What babbles behind Marilyn Rudolph’s house in the rural countryside is no brook.A stained PVC pipe juts out of the ground 30 feet behind her modest, well-maintained house, spewing raw wastewater whenever someone flushes the toilet or runs the washing machine. It is what is known as a “straight pipe” — a rudimentary, unsanitary and notorious homemade sewage system used by thousands of poor people in rural Alabama, most of them Black, who cannot afford a basic septic tank that will work in the region’s dense soil.“I’ve never seen anything like it. It’s kind of like living with an outhouse, and I can never, ever get used to it,” said Ms. Rudolph’s boyfriend Lee Thomas, who moved in with her three years ago from Cleveland.“I’ve lived with it all my life,” said Ms. Rudolph, 60.If any part of the country stands to see transformational benefits from the $1 trillion infrastructure act that President Biden signed in November, it is Alabama’s Black Belt, named for the loamy soil that once made it a center of slave-labor cotton production. It is an expanse of 17 counties stretching from Georgia to Mississippi where Black people make up three-quarters of the population.About $55 billion of the infrastructure law’s overall funding is dedicated to upgrading systems around the country that handle drinking water, wastewater and stormwater, including $25 billion to replace failing drinking-water systems in cities like Flint, Mich., and Jackson, Miss.Hayneville’s town square. The infrastructure package targets funding toward “disadvantaged” areas like Hayneville and surrounding towns, part of the Biden administration’s goal of redressing structural racism.Charity Rachelle for The New York TimesLess attention has been paid to the other end of the pipe: $11.7 billion in new funding to upgrade municipal sewer and drainage systems, septic tanks, and clustered systems for small communities. It is a torrent of cash that could transform the quality of life and economic prospects for impoverished communities in Alabama, Mississippi, North Carolina, Oklahoma, Illinois, Michigan and many tribal areas.In this part of Alabama, the center of the civil rights struggle 60 years ago, the funding represents “a once-in-a-lifetime chance to finally make things right, if we get it right,” said Helenor Bell, the former mayor of Hayneville in Lowndes County, who runs the town’s funeral home.But while the funding is likely to lead to substantial improvements, there are no guarantees it will deliver the promised benefits to communities that lack the political power or the tax base to employ even the few employees needed to fill out applications for federal aid.“I am very worried,” said Catherine Coleman Flowers, a MacArthur fellow whose 2020 book “Waste” highlighted the sanitation crisis in Lowndes County. “Without federal intervention, we would have never had voting rights. Without federal intervention, we will never have sanitation equity.”Mark A. Elliott is an engineering professor at the University of Alabama who works with an academic consortium that is designing a waste system optimized for the region’s dense clay soil. He said he was concerned that more affluent parts of the state might siphon off federal assistance intended for the poor.“My hope is that at least 50 percent of this money goes to the people who are in most desperate need, not for helping to subsidize the water bills of wealthy communities,” Mr. Elliott said. “Sanitation is a human right, and these people need help.”Straight pipes are just one element of a more widespread breakdown of antiquated septic tanks, inadequate storm sewers and poorly maintained municipal systems that routinely leave lawns covered in foul-smelling wastewater after even a light rainstorm.The infrastructure package targets funding toward “disadvantaged” areas like Hayneville and surrounding towns, part of the Biden administration’s goal of redressing structural racism. As an additional enticement, Congress cut the required state contribution from 20 percent to 10 percent.“A lot of people know that the bill isn’t just about drinking water, but the wastewater part is just as important,” said Senator Tammy Duckworth, Democrat of Illinois, who helped draft the provisions after assisting two small cities in her state, Cahokia Heights and Cairo, upgrade failing sewer systems that flooded neighborhoods with raw sewage.The Environmental Protection Agency, which is administering the program, said in November that the first tranche of funding for drinking water and wastewater projects, $7.4 billion, would be sent to states in 2022, including about $137 million for Alabama.Biden administration officials are confident the scale of the new spending — which represents a threefold increase in clean water funding over the next five years — will be enough to ensure poor communities gets their fair share. “We want to change the way E.P.A. and states work together to ensure overburdened communities have access to these resources,” said Zachary Schafer, an agency official overseeing the implementation of the program. But major questions remain — including whether individual homeowners without access to municipal systems can tap the money to pay for expensive septic systems — and the guidelines will not be ready until late 2022. While the revolving loan fund is generally regarded as a successful program, a study last year by the Environmental Policy Innovation Center and the University of Michigan found that many states were less likely to tap revolving loan funds on behalf of poor communities with larger minority populations.Alabama’s revolving loan fund has financed few projects in this part of the state in recent years, apart from a major wastewater system upgrade in Selma, according to the program’s annual reports.The water funding is not likely to be divvied up in Alabama until later this year. The Republican-controlled state legislature is still negotiating with Gov. The election is expected to be held early next year, though the N.LR.B. still needs to set a date.The previous union election at Amazon involved a few dozen technical workers at a warehouse in Delaware in 2014. They decided not to unionize.Amazon is undertaking a historic hiring spree during the pandemic, adding 1,400 employees a day and putting the company on a pace to become the nation’s largest private employer in a few years.“We don’t believe this group represents the majority of our employees’ views,” an Amazon spokeswoman, Heather Knox, said in a statement about the union. “Our employees choose to work at Amazon because we offer some of the best jobs available everywhere we hire, and we encourage anyone to compare our overall pay, benefits and workplace environment to any other company with similar jobs.”The Retail, Wholesale and Department Store Union represents workers at brick-and-mortar retailers like Macy’s flagship store in Herald Square, H&M and Zara. The union’s ranks also include a diverse mix of workers at places like the General Mills factory that makes cereal in Iowa and poultry plants across the South.The union was involved in opposing Amazon’s proposal to build a second headquarters in New York, around the same time it was trying to organize workers at the company’s large warehouse on Staten Island. It also points to its starting wage of $15 an hour and health care benefits. Labor advocates and some elected officials have still raised concerns about the rates of injuries in warehouses, inflexible work schedules and the surveillance of workers to maximize productivity.The company has also been accused of retaliating against workers who speak out. Last week, the N.L.R.B. said it had found merit in a worker’s claim that Amazon illegally retaliated against him for staging protests this spring outside the Staten Island warehouse to draw attention to concerns about safety during the pandemic. Amazon said the worker had been fired for “a clear violation of our standards of conduct and harassment policy.”The Bessemer warehouse opened just as Covid-19 arrived in the United States. Amazon announced plans for it in 2018, part of an expansion into midsize metropolitan areas so the company could store more products closer to customers for quick delivery. The local economy used to depend on steel industry jobs, but those have largely disappeared, and Amazon, which pledged to hire 1,500 people, received $51 million in local and state tax incentives. Average pay at the warehouse is $15.30 an hour, Ms. Knox said.In November, the union submitted its petition to hold the election, saying it had sufficient support among the workers it said should be part of the bargaining unit. The company asked for more time to prepare a response, citing the busy holiday shopping season.“This is a year where more consumers than ever are shopping online and expecting prompt and accurate deliveries,” Amazon said in a filing with the N.L.R.B.Haggling over the terms of a union election can drag on for months, but this process moved relatively quickly. The union filed a petition for the election with the N.L.R.B. about a week before Thanksgiving.Over the course of the hearing, which began on Friday, lawyers for the union and Amazon discussed how many workers at the center should be allowed to vote. Amazon argued that temporary workers, usually hired during the holiday season, should be included, along with full-time and part-time employees performing the same tasks.The union agreed to include the seasonal workers, even though it means expanding the pool of employees it needs to win over. But by conceding the seasonal issue, the union probably avoided days of testimony from Amazon that could have stretched well past Christmas and slowed some of the organizing momentum.“Our interest is in making sure there is an election soon,” Richard Rouco, a lawyer for the union, said on Monday.The other sticking point is whether the voting should occur in person or by mail. Amazon wants the election to occur in person, even though the N.L.R.B. has raised serious concerns about exposing its election monitors to the coronavirus in the Bessemer area, where there has been a high rate of virus infections.Harry Johnson, a lawyer for Amazon, suggested that local hotel rooms and buses could be rented exclusively for the federal officials to prevent them from being exposed while they conducted the election.Mr. Rouco retorted, “I am not going to let Amazon buy a city” to prevent workers from voting by mail.The N.LR.B.’s regional office in Atlanta is expected to rule on the mail-voting issue early next month.AdvertisementContinue reading the main story More
