    Microsoft Agrees to Remain Neutral in Union Campaigns

    The pledge is unprecedented for Big Tech and makes it easier for roughly 100,000 workers to unionize.Punctuating a year of major gains for organized labor, Microsoft has announced that it will stay neutral if any group of U.S.-based workers seeks to unionize.Roughly 100,000 workers would be eligible to unionize under the framework, which was disclosed Monday by Microsoft’s president, Brad Smith, and the A.F.L.-C.I.O. president, Liz Shuler, during a forum at the labor federation’s headquarters in Washington.The deal effectively broadens a neutrality agreement between Microsoft and a large union, the Communications Workers of America, under which hundreds of the company’s video game workers unionized early this year without a formal National Labor Relations Board election. Officially, it provides a framework in which any group of Microsoft workers can negotiate their own neutrality agreements with similar terms.As part of Monday’s announcement, Microsoft and the A.F.L.-C.I.O. said they would collaborate to resolve issues that arise from the adoption of artificial intelligence in the workplace.Mr. Smith and Ms. Shuler said the partnership would include meetings in which artificial intelligence experts from Microsoft brief labor leaders and workers on developments in the field. Microsoft’s experts will also seek input from workers so they can develop technology in a way that addresses their concerns, such as the risk of job elimination.The two sides said they would work together to help enact policies that would prepare workers for jobs that incorporate artificial intelligence.“Never before in the history of these American tech giants, dating back 50 years or so ago, has one of these companies made a broad commitment to labor rights,” Ms. Shuler said at the forum. “It is historic. Hollywood writers and actors cited concerns about A.I. as a key reason for their monthslong strikes this year, while Ms. Shuler pointed to recent polling showing widespread concern among workers that artificial intelligence could cost them their jobs.“I can’t sit here and say it will never displace a job,” Mr. Smith said at the forum, alluding to artificial intelligence. “I don’t think that would be honest.” But he added that “the key is to try to use it to make jobs better,” saying the technology could eliminate tasks that people consider tedious.The unveiling of the A.I. initiative comes a few weeks after the board of the start-up OpenAI, which makes ChatGPT, fired the company’s chief executive, Sam Altman, only to accept his reinstatement days later. The episode added to widespread concerns over how to ensure that companies develop and deploy artificial intelligence safely.Microsoft is OpenAI’s biggest investor and played a role in reinstating Mr. Altman.Asked if the OpenAI controversy was an impetus for the new partnership with organized labor, Mr. Smith demurred and said the labor initiative had been in the works for months.“I wouldn’t say what happened in the board room at OpenAI changed it,” he said in an interview after Monday’s forum. “But it raised questions about how A.I. is governed and perhaps it gave even more credence to the kind of partnership we’re announcing today.”When Microsoft announced a neutrality agreement with the communications workers union in June 2022, the offer was conditional: The company was in the process of acquiring the video game maker Activision Blizzard for nearly $70 billion. Microsoft pledged to stay neutral in union elections at Activision if the acquisition succeeded. (The acquisition has since been completed.)The key to artificial intelligence, said Brad Smith, Microsoft’s president, is “to try to use it to make jobs better.”Michael A.     Apple Store in Oklahoma City Becomes Second to Unionize

    Workers said pay was adequate and benefits were good, but complained that managers’ practices often seemed arbitrary.Apple employees at a store in Oklahoma City have voted to unionize, becoming the second of the company’s roughly 270 U.S. retail stores to do so.The result, announced by the National Labor Relations Board on Friday night, suggests that an initial victory by a union at a store in Towson, Md., in June was not an isolated development in an organizing campaign that dates back to last year.According to the labor board, 56 employees voted in favor of the union and 32 voted against. The company recently raised the minimum starting wage at its stores to $22 an hour and said it had increased starting wages by 45 percent in the United States since 2018.But workers complained that supervisors’ decisions about hiring, pay and job assignments were often opaque and said a union would bring greater transparency to their store.Leigha Briscoe, an employee involved in the organizing who works in sales, said employees were given very different tasks during the first year of the pandemic, when they often worked from home, with little explanation for the disparities.“Some people were at home making posters, doing drawing projects, and others were on the phone taking calls eight hours a day,” Ms. Briscoe said. “There was a lack of clarity as to what the plan was.”Workers also cited confusion over how to earn promotions at the store.“Some people have been in their current roles for years trying to get promoted and are not really getting anywhere, but whenever they get feedback on an interview for a promotion what they get is very subjective goals,” said Michael Forsythe, another employee involved in the organizing, who helps oversee the repair room at the store.Mr. Forsythe said workers were sometimes told to work on their “customer focus,” but were not given more concrete suggestions like “I want you to have a three-week average of 80 percent customer satisfaction score.”Mr. Forsythe said the idea of unionizing first occurred to him late last year, after employees across the company had begun to protest management’s plans to bring them back to the office. The protest ballooned into a broader campaign, known as #AppleToo, that sought to highlight a variety of workplace problems, including harassment and pay disparities, and caught Mr. Forsythe’s attention.In April, a store in Atlanta filed a petition for a union election, and Mr. Forsythe and other employees at the Oklahoma City store began to discuss unionization.The Atlanta store later withdrew its petition, as the company announced a raise and highlighted the benefits it offered and the potential costs of unionizing, denting support for the union.But by then, the Oklahoma City store had formed an organizing committee and more employees were expressing interest in a union. The Oklahoma City workers filed their petition in early September.Employees said supervisors had responded to their campaign by holding round-table discussions and one-on-one conversations in which they emphasized the downsides of a union, including the dues that workers would have to pay and the possibility that they could lose benefits during the bargaining process. Supervisors also said having a union would make it harder to change workplace arrangements when they were in need of updating, like during the pandemic, according to these employees.Workers at the Oklahoma City store said their market leader, a manager who oversees several locations, was in their store regularly during the campaign, even though they would typically see him no more than a few times a year.Patrick Hart, an employee at the store who helps customers resolve issues with products, said the impact of the company’s response was limited because many employees did their own research about how joining a union would affect them.“We are all extremely educated people — Apple hires a certain kind of person,” Mr. Hart said. “We know how to look into things.” More

    Microsoft Pledges Neutrality in Union Campaigns at Activision

    The accord could ease the path for thousands of workers to unionize at the game company, which Microsoft is acquiring, and addresses an antitrust objection.Microsoft and the Communications Workers of America union announced an agreement on Monday that would make it easier for employees to unionize at the video game maker Activision Blizzard, which Microsoft is acquiring for $70 billion.Under the deal, which appears to be the first of its kind in the technology industry, Microsoft agreed to remain neutral if any of Activision’s eligible U.S. employees want to unionize, and employees would no longer have to petition the National Labor Relations Board for an election. The company has almost 7,000 employees in the United States, most of whom will be eligible to unionize under the arrangement.A group of nearly 30 employees at one of Activision’s studios voted to unionize through an N.L.R.B. election in May despite Activision’s opposition to holding the election. But completing such a process can be time consuming, with unions and employers sometimes spending months or even years litigating the results.Through the agreement, workers will have access to an expedited process for unionizing, overseen by a neutral third party, in which they will indicate their support for a union either by signing cards or confidentially through an electronic platform.“This process does gives us and Microsoft a way to do this quote unquote election without spending the time, the effort and the controversy that goes along with an N.L.R.B. election,” Chris Shelton, the president of the Communications Workers union, said in an interview.The union said that the neutrality agreement resolved the antitrust concerns it had with the acquisition, and that it now supported the deal, which Microsoft has said will close by the end of next June.Mr. Shelton and Brad Smith, Microsoft’s president, suggested that the deal could pave the way to wider unionization across the company and the industry. “This is a great opportunity for us to work with Chris and the C.W.A. and to learn and innovate,” Mr. Smith said in an interview. Microsoft said it was prepared to “build on” the deal in the future, but did not specifically comment on whether it planned to extend the terms to other gaming workers at the company.Microsoft indicated that under the agreement, it would refrain from an aggressive anti-union campaign if other Activision employees sought to unionize. “In practical terms, it means that we’re not going to try to jump in and put a thumb on the scale,” Mr. Smith said in the interview. “We will respect the fact that our employees are capable of making decisions for themselves and they have a right to do that.”Brad Smith of Microsoft said he was committed to engaging with unions “when employees wish to exercise their rights and Microsoft is presented with a specific unionization proposal.”Markus Schreiber/Associated PressFacing their own union campaigns, companies like Amazon and Starbucks have held frequent mandatory meetings with employees to argue that a union could leave them worse off.The labor board has issued complaints against Amazon that include accusations of threatening workers with a loss of benefits if they unionize, and against Starbucks over accusations that it fired workers who sought to form a union and effectively promised benefits to workers if they chose not to unionize. Both companies have denied the accusations. In a recent case brought by the N.L.R.B. in Arizona, a federal judge denied a request for an injunction to reinstate pro-union workers whom the labor board said Starbucks had forced out illegally.The agreement between Microsoft and the union would also protect workers’ right to communicate among themselves and with union officials about a union campaign — something many employers seek to discourage — and stipulates that disagreements between the company and the union will be resolved through an “expedited arbitration process.” N.L.R.B. complaints can take months or years to resolve.When Microsoft and Activision announced their blockbuster deal in January, the game maker was under stress as it faced accusations that senior executives had ignored sexual harassment and discrimination. Those concerns spurred organizing among Activision employees, including workers at its Raven Software studio in Wisconsin, which has developed games in popular franchises like Call of Duty.After a group of roughly 30 quality assurance, or Q.A., workers announced that they were seeking to unionize, Activision sought to convince the federal labor board that their election should not go forward. The game workers accused Activision of union-busting tactics, like increasing the pay of non-Raven Q.A. workers and splitting Q.A. workers up by embedding them across the Raven studio.Activision maintained that while some changes in this vein had come after the union campaign went public, the broader shift in approach had already been underway — for example, its move to change the status of hundreds of temporary and contingent workers to permanent full-time employees in the fall.The company argued that the entire Raven studio, comprising hundreds of workers, should have been allowed to vote on forming a union, rather than just a few dozen Q.A. workers. Q.A. employees, often on temporary contracts, are commonly considered the most overworked and underpaid members of game studios.In early March, the union signed a letter asking federal regulators to scrutinize the acquisition. “The potential takeover by Microsoft threatens to further undermine workers’ rights and suppress wages,” the letter said.Microsoft has since tried to strike a conciliatory tone. It said it would not stop Activision from voluntarily recognizing the union before a formal election, which Activision did not do. After the Raven Q.A. workers voted in late May to form the first union at a major North American game publisher, Phil Spencer, the head of gaming at Microsoft, told employees that he would recognize the Raven union once the deal between the two companies closed, the gaming news site Kotaku reported, citing a video of an employee town hall.Activision said on Friday that it was starting contract negotiations with the newly unionized Raven workers. “We decided to take this important step forward with our 27 represented employees and C.W.A. to explore their ideas and insights for how we might better serve our employees, players and other stakeholders,” Bobby Kotick, the company’s chief executive, said in a statement.In a blog post this month that appeared to foreshadow the deal, Mr. Smith announced a set of principles to guide Microsoft’s response to labor organizing, an indication that it was taking a more open approach across the company’s businesses.He wrote that he had observed Microsoft’s successful “collaborative experiences with works councils and unions” while working in Europe and said that in the United States the company would pursue “collaborative approaches that will make it simpler, rather than more difficult, for our employees to make informed decisions and to exercise their legal right to choose whether to form or join a union.”In the interview, Mr. Smith called the neutrality agreement “our first opportunity to put those principles into practice.”The Communications Workers of America, which represents employees at companies like AT&T Mobility, Verizon and The New York Times, has sought to organize tech industry workers in recent years. It follows increasing demands by employees at Google for policy overhauls on pay, harassment and ethics, and is likely to escalate tensions with top leadership.The new union, called the Alphabet Workers Union after Google’s parent company, Alphabet, was organized in secret for the better part of a year and elected its leadership last month. The group is affiliated with the Communications Workers of America, a union that represents workers in telecommunications and media in the United States and Canada.But unlike a traditional union, which demands that an employer come to the bargaining table to agree on a contract, the Alphabet Workers Union is a so-called minority union that represents a fraction of the company’s more than 260,000 full-time employees and contractors. Workers said it was primarily an effort to give structure and longevity to activism at Google, rather than to negotiate for a contract.Chewy Shaw, an engineer at Google in the San Francisco Bay Area and the vice chair of the union’s leadership council, said the union was a necessary tool to sustain pressure on management so that workers could force changes on workplace issues.“Our goals go beyond the workplace questions of, ‘Are people getting paid enough?’ Our issues are going much broader,” he said. “It is a time where a union is an answer to these problems.”In response, Kara Silverstein, Google’s director of people operations, said: “We’ve always worked hard to create a supportive and rewarding workplace for our work force. Of course, our employees have protected labor rights that we support. But as we’ve always done, we’ll continue engaging directly with all our employees.”The new union is the clearest sign of how thoroughly employee activism has swept through Silicon Valley over the past few years. In 2018, more than 20,000 employees staged a walkout to protest how the company handled sexual harassment. Others have opposed business decisions that they deemed unethical, such as developing artificial intelligence for the Defense Department and providing technology to U.S. Customs and Border Protection.Even so, unions have not previously gained traction in Silicon Valley. Many tech workers shunned them, arguing that labor groups were focused on issues like wages — not a top concern in the high-earning industry — and were not equipped to address their concerns about ethics and the role of technology in society. Labor organizers also found it difficult to corral the tech companies’ huge workforces, which are scattered around the globe.Only a few small union drives have succeeded in tech in the past. Workers at the crowdfunding site Kickstarter and at the app development platform Glitch won union campaigns last year, and a small group of contractors at a Google office in Pittsburgh unionized in 2019. Thousands of employees at an Amazon warehouse in Alabama are also set to vote on a union in the coming months.“There are those who would want you to believe that organizing in the tech industry is completely impossible,” Sara Steffens, C.W.A.’s secretary-treasurer, said of the new Google union. “If you don’t have unions in the tech industry, what does that mean for our country? That’s one reason, from C.W.A.’s point of view, that we see this as a priority.”Veena Dubal, a law professor at the University of California, Hastings College of the Law, said the Google union was a “powerful experiment” because it brought unionization into a major tech company and skirted barriers that have prevented such organizing.“If it grows — which Google will do everything they can to prevent — it could have huge impacts not just for the workers, but for the broader issues that we are all thinking about in terms of tech power in society,” she said.The union is likely to ratchet up tensions between Google engineers, who work on autonomous cars, artificial intelligence and internet search, and the company’s management. Sundar Pichai, Google’s chief executive, and other executives have tried to come to grips with an increasingly activist work force — but have made missteps.Last month, federal officials said Google had wrongly fired two employees who protested its work with immigration authorities in 2019. Timnit Gebru, a Black woman who is a respected artificial intelligence researcher, also said last month that Google fired her after she criticized the company’s approach to minority hiring and the biases built into A.I. systems. Her departure set off a storm of criticism about Google’s treatment of minority employees.“These companies find it a bone in their throat to even have a small group of people who say, ‘We work at Google and have another point of view,’” said Nelson Lichtenstein, the director of the Center for the Study of Work, Labor and Democracy at the University of California, Santa Barbara. “Google might well succeed in decimating any organization that comes to the floor.”The Alphabet Workers Union, which represents employees in Silicon Valley and cities like Cambridge, Mass., and Seattle, gives protection and resources to workers who join. Those who opt to become members will contribute 1 percent of their total compensation to the union to fund its efforts.Over the past year, the C.W.A. has pushed to unionize white-collar tech workers. (The NewsGuild, a union that represents New York Times employees, is part of C.W.A.) The drive focused initially on employees at video game companies, who often work grueling hours and face layoffs.In late 2019, C.W.A. organizers began meeting with Google employees to discuss a union drive, workers who attended the meetings said. Some employees were receptive and signed cards to officially join the union last summer. In December, the Alphabet Workers Union held elections to select a seven-person executive council.But several Google employees who had previously organized petitions and protests at the company objected to the C.W.A.’s overtures. They said they declined to join because they worried that the effort had sidelined experienced organizers and played down the risks of organizing as it recruited members.Google employees staged a walkout in 2018 to protest how the company handled sexual harassment.Credit…Bebeto Matthews/Associated PressAmr Gaber, a Google software engineer who helped organize the 2018 walkout, said that C.W.A. officials were dismissive of other labor groups that had supported Google workers during a December 2019 phone call with him and others.“They are more concerned about claiming turf than the needs of the workers who were on the phone call,” Mr. Gaber said. “As a long-term labor organizer and brown man, that’s not the type of union I want to build.”The C.W.A. said it was selected by Google workers to help organize the union and had not elbowed their way in. “It’s really the workers who chose,” Ms. Steffens of C.W.A. said.Traditional unions typically enroll a majority of a work force and petition a state or federal labor board like the National Labor Relations Board to hold an election. If they win the vote, they can bargain with their employer on a contract. A minority union allows employees to organize without first winning a formal vote before the N.L.R.B.The C.W.A. has used this model to organize groups in states where it said labor laws are unfavorable, like the Texas State Employees Union and the United Campus Workers in Tennessee.The structure also gives the union the latitude to include Google contractors, who outnumber full-time workers and who would be excluded from a traditional union. Some Google employees have considered establishing a minority or solidarity union for several years, and ride-hailing drivers have formed similar groups.Although they will not be able to negotiate a contract, the Alphabet Workers Union can use other tactics to pressure Google into changing its policies, labor experts said.
