    E.U. Considers Due Diligence Law for Company Supply Chains

    Large companies operating in the European Union could be held responsible for environmental violations or human rights abuses committed by businesses in their supply chains under a law proposed on Wednesday by the European Commission, the bloc’s administrative arm.“We can no longer turn a blind eye on what happens down our value chains,” said Didier Reynders, the European Union’s commissioner for justice.Under the legislation, known as a due diligence law, businesses would need to establish regulations to detect, prevent and mitigate breaches of human rights, such as child labor, as well as environmental hazards in their supply chains. National governments would define the financial penalties for companies violating the rules.Victims could sue for compensation in domestic courts of E.U. member nations, even if the harm occurred outside the bloc.The commission proposed the rules after some member nations, including Germany and France, introduced different versions of due diligence law at the national level.The legislation will now be discussed by the European Parliament and the 27 national governments, with all parties able to modify the language. The final draft will require passage by the E.U. lawmakers and member nations. The whole process could take a year or more.The proposal would initially apply to companies with more than 500 employees and annual revenue over 150 million euros (about $170 million), a group that includes about 10,000 E.U. businesses, about 1 percent of the total. Around 2,000 companies based outside the bloc but doing business in the European Union, amounting to an annual revenue of more than €150 million, would also be covered. After two years, the range would be expanded to include smaller businesses in so-called high-impact sectors, such as textiles, food products and mining.Businesses expressed concern over the proposal.“It is unrealistic to expect that European companies can control their entire value chains across the world,” said Pierre Gattaz, president of BusinessEurope, a trade organization. “Ultimately these proposals will harm our companies’ ability to remain competitive worldwide.”But Richard Gardiner of Global Witness said the legislation had the potential to become “a watershed moment for human rights and the climate crisis,” if the European Union resisted efforts to water down the proposed measures.“We’ve been investigating big corporations for decades, and when we reveal the harm they’re causing to people and planet, the response is invariably the same: ‘We weren’t aware,’” Mr. Gardiner said. “Today’s proposal from the commission may make that response illegal.”But some analysts remained skeptical, pointing out that the commission’s final proposal, which was delayed several times, is much less ambitious than what was initially planned.“This outcome is the result of an unprecedented level of corporate lobbying,” said Alberto Alemanno, a professor of European Union law at the business school HEC Paris.     Why Companies Struggled to Navigate Olympics Sponsorships

    The debacle over Olympic sponsorship shows how the U.S.-China relationship has turned into a minefield for companies trying to do business in both countries.WASHINGTON — Companies usually shell out for Olympic sponsorship because it helps their business and reflects well on their brands. But this year, with the Olympics in Beijing, Procter & Gamble paid even more to try to prevent any negative fallout from being associated with China’s repressive and authoritarian government.The company, one of 13 “worldwide Olympic partners” that make the global sports competition possible, hired Washington lobbyists last year to successfully defeat legislation that would have barred sponsors of the Beijing Games from selling their products to the U.S. government. Tesla, which counts China as one of its largest markets, opened a showroom in Xinjiang last month.“We can’t leave China, because China represents in some industries up to 50 percent of global demand and we have intense, deep supply and sales relationships,” said Craig Allen, the president of the U.S.-China Business Council.Companies see China as a foothold to serve Asia, Mr. Allen said, and China’s $17 trillion economy still presents “some of the best growth prospects anywhere.”“Very few companies are leaving China, but all are feeling that it’s risk up and that they need to be very careful so as to meet their legal obligations in both markets,” he said.American politicians of both parties are increasingly bent on forcing companies to pick a side.“To me, it’s completely appropriate to make these companies choose,” said Representative Michael Waltz, a Florida Republican who proposed the bill that would have prevented Olympic sponsors from doing business with the U.S. government.Mr. Waltz said participation in the Beijing Olympics sent a signal that the West was willing to turn a blind eye to Chinese atrocities for short-term profits.The amendment was ultimately cut out of a defense-spending bill last year after active and aggressive lobbying by Procter & Gamble, Coca-Cola, Intel, NBC, the U.S. Chamber of Commerce and others, Mr. Waltz said.Procter & Gamble’s lobbying disclosures show that, between April and December, it spent more than $2.4 million on in-house and outside lobbyists to try to sway Congress on a range of tax and trade issues, including the Beijing Winter Olympics Sponsor Accountability Act.Lobbying disclosures for Coca-Cola, Airbnb and Comcast, the parent company of NBC, also indicate the companies lobbied on issues related to the Olympics or “sports programming” last year.Procter & Gamble and Intel declined to comment. Coca-Cola said it had explained to lawmakers that the legislation would hurt American military families and businesses. NBC and the Chamber of Commerce did not respond to requests for comment.Many companies have argued they are sponsoring this year’s Games to show support for the athletes, not China’s system of government.In a July congressional hearing, where executives from Coca-Cola, Intel, Visa and Airbnb were also grilled about their sponsorship, Mr. Mulvaney said Procter & Gamble was using its partnership to encourage the International Olympic Committee to incorporate human rights principles into its oversight of the Games.“Corporate sponsors are being a bit unfairly maligned here,” Anna Ashton, a senior fellow at the Asia Society Policy Institute, said in an event hosted by the Center for Strategic and International Studies, a Washington think tank.Companies had signed contracts to support multiple iterations of the Games, and had no say over the host location, she said.     Democrats Renew Push for Industrial Policy Bill Aimed at China

    A major competitiveness bill passed the Senate last year with bipartisan support, only to stall. Democrats hope to revive it in the House, but first they will have to bridge big differences.WASHINGTON — Biden administration officials and Democrats in Congress are pushing to revive stalled legislation that would pour billions of dollars into scientific research and development and shore up domestic manufacturing, amid deep differences on Capitol Hill about the best way to counter China and confront persistent supply chain woes.House Democrats unveiled a 2,900-page bill on Tuesday evening that would authorize $45 billion in grants and loans to support supply chain resilience and American manufacturing, along with providing billions of dollars in new funding for scientific research. Speaker Nancy Pelosi said in a statement that she hoped lawmakers would quickly begin negotiations with the Senate, which passed its own version of the bill last June, to settle on compromise legislation that could be sent to President Biden for his signature.But the effort faces obstacles in Congress, where attempts to sink significant federal resources into scientific research and development to bolster competitiveness with China and combat a shortage of semiconductors have faltered. The Senate-passed measure fizzled last year amid ideological disputes with the House and a focus on efforts to pass Mr. Biden’s infrastructure and social policy bills. For months, the competitiveness measure was rarely even mentioned, except perhaps by Senator Chuck Schumer, Democrat of New York and the majority leader, who has personally championed it.But facing a disruptive semiconductor shortage that has broken down supply chains and helped fuel inflation, Democrats are now vigorously pressing ahead on the bill. With Mr. Biden’s domestic agenda sputtering, the party is eager for a legislative victory, and top administration officials and lawmakers have said they hope to send a compromise bill to the president’s desk in a matter of months.“We have no time to waste in improving American competitiveness, strengthening our lead in global innovation and addressing supply chain challenges, including in the semiconductor industry,” Mr. Schumer said.Both the House bill and the one that passed the Senate last year would send a lifeline to the semiconductor industry during a global chip shortage that has shut auto plants and rippled through the economy.     Commerce Dept. Survey Uncovers ‘Alarming’ Chip Shortages

    Increased demand for the semiconductors that power cars, electronics and electrical grids have stoked inflation and could cause more factory shutdowns in the United States.WASHINGTON — The United States is facing an “alarming” shortage of semiconductors, a government survey of more than 150 companies that make and buy chips found; the situation is threatening American factory production and helping to fuel inflation, Gina M. Raimondo, the commerce secretary, said in an interview on Monday.She said the findings showed a critical need to support domestic manufacturing and called on Congress to pass legislation aimed at bolstering U.S. competitiveness with China by enabling more American production.“It’s alarming, really, the situation we’re in as a country, and how urgently we need to move to increase our domestic capacity,” Ms. Raimondo said.The findings show demand for the chips that power cars, electronics, medical devices and other products far outstripping supply, even as global chip makers approach their maximum production capacity.While demand for semiconductors increased 17 percent from 2019 to 2021, there was no commensurate increase in supply. A vast majority of semiconductor fabrication plants are using about 90 percent of their capacity to manufacture chips, meaning they have little immediate ability to increase their output, according to the data that the Commerce Department compiled.The need for chips is expected to increase, as technologies that use vast amounts of semiconductors, like 5G and electric vehicles, become more widespread.The combination of surging demand for consumer products that contain chips and pandemic-related disruptions in production has led to shortages and skyrocketing prices for semiconductors over the past two years.Chip shortages have forced some factories that rely on the components to make their products, like those of American carmakers, to slow or suspend production. That has dented U.S. economic growth and led to higher car prices, a big factor in the soaring inflation in the United States. The price of a used car grew 37 percent last year, helping to push inflation to a 40-year high in December.The Commerce Department sent out a request for information in September to global chip makers and consumers to gather information about inventories, production capacity and backlogs in an effort to understand where bottlenecks exist in the industry and how to alleviate them.The results of that survey, which the Commerce Department published Tuesday morning, reveal how scarce global supplies of chips have become.The median inventory among buyers had fallen to fewer than five days from 40 days before the pandemic, meaning that any hiccup in chip production — because of a winter storm, for example, or another coronavirus outbreak — could cause shortages that would shut down U.S. factories and again destabilize supply chains, Ms. Raimondo said.“We have no room for error,” she added.To help address the issue, Biden administration officials have coalesced behind a bill that the Senate passed in June as an answer to some of the nation’s supply chain woes.The bill, known in the Senate as the U.S. Innovation and Competition Act, would pour nearly a quarter-trillion dollars into scientific research and development to bolster competitiveness against China and prop up semiconductor makers by providing $52 billion in emergency subsidies.Momentum on the legislation stalled amid ideological disputes between the House and Senate over how to direct the funding.     U.S. Effort to Combat Forced Labor Targets Corporate China Ties

    The Biden administration is expected to face scrutiny as it decides how to enforce a new ban on products made with forced labor in the Xinjiang region of China.A far-reaching bill aimed at barring products made with forced labor in China became law after President Biden signed the bill on Thursday.But the next four months — during which the Biden administration will convene hearings to investigate how pervasive forced labor is and what to do about it — will be crucial in determining how far the legislation goes in altering the behavior of companies that source products from China.While it is against U.S. law to knowingly import goods made with slave labor, the Uyghur Forced Labor Prevention Act shifts the burden of proof to companies from customs officials. Firms will have to proactively prove that their factories, and those of all their suppliers, do not use slavery or coercion.The law, which passed the House and Senate nearly unanimously, is Washington’s first comprehensive effort to police supply chains that the United States says exploit persecuted minorities, and its impact could be sweeping. A wide range of products and raw materials — such as petroleum, cotton, minerals and sugar — flow from the Xinjiang region of China, where accusations of forced labor proliferate. Those materials are often used in Chinese factories that manufacture products for global companies.“I anticipate that there will be many companies — even entire industries — that will be taken by surprise when they realize that their supply chains can also be traced back to the Uyghur region,” said Laura Murphy, a professor of human rights and contemporary slavery at Sheffield Hallam University in Britain.If the law is enforced as written, it could force many companies to rework how they do business or risk having products blocked at the U.S. border. Officials from the Labor Department and the United States Trade Representative were more sympathetic to a far-reaching ban on Xinjiang goods, according to three people familiar with the discussions. Companies and various government agencies became nervous that the law’s broad authorities could prove “devastating to the U.S. economy,” she said.“The need to improve our clean energy is real and important, but not something that the government or the U.S. should do on the backs of people who are working under conditions of modern-day slavery,” Ms. Hinojosa added.In a call with Speaker Nancy Pelosi of California this year, Mr. Kerry conveyed concerns about disrupting solar supply chains while Ms. Sherman shared her concerns with Senator Jeff Merkley, Democrat of Oregon, according to people familiar with the conversations.Mr. Merkley, one of the lead sponsors of the bill, said in an interview that Ms. Sherman told him she was concerned the legislation was not duly “targeted and deliberative.” The conversation was first reported by The Washington Post.“I think this is a targeted and deliberative approach,” Mr. Merkley said. “And I think the administration is starting to see how strongly Republicans and Democrats in both chambers feel about this.”A State Department official said that Ms. Sherman did not initiate the call and did not express opposition to the bill. Many companies complain that beyond their direct suppliers, they lack the leverage to demand information from the Chinese firms that manufacture raw materials and parts.Government restrictions that bar foreigners from unfettered access to sites in Xinjiang have made it difficult for many businesses to investigate their supply chains. New Chinese antisanctions rules, which threaten penalties against companies that comply with U.S. restrictions, have made vetting even more difficult.The Chinese government denies forced labor is used in Xinjiang. Zhao Lijian, a government spokesman, said U.S. politicians were “seeking to contain China and hold back China’s development through political manipulation and economic bullying in the name of ‘human rights.’” He promised a “resolute response” if the bill became law.Lawmakers struggled over the past year to reconcile a more aggressive House version of the legislation with one in the Senate, which gave companies longer timelines to make changes and stripped out the S.E.C. reporting requirement, among other differences.The final bill included a mechanism to create lists of entities and products that use forced labor or aid in the transfer of persecuted workers to factories around China.     The Path Ahead for Biden: Overcome Manchin’s Inflation Fears

    A key Democrat’s decision to pull support from the president’s sprawling climate and social agenda is rooted in the scope of the bill.WASHINGTON — Senator Joe Manchin III, the West Virginia Democrat, effectively killed President Biden’s signature domestic policy bill in its current form on Sunday, saying he was convinced the spending and tax cuts in the $2.2 trillion legislation will exacerbate already hot inflation.Economic evidence strongly suggests Mr. Manchin is wrong. A host of economists and independent analyses have concluded that the bill is not economic stimulus, and that it will not pump enough money into consumer pocketbooks next year to raise prices more than a modest amount.The reason has to do with the pace at which the bill spends money and how much it raises through tax increases that are intended to pay for that spending. The legislation spends funds over a decade, allowing the taxes it raises on wealthy Americans and businesses, which will siphon money out of the economy, to help counteract the boost from spending and tax cuts.The bill also does not provide the type of direct stimulus included in the $1.9 trillion pandemic aid package Mr. Biden signed in March — and which Mr. Manchin supported. Some of its provisions would give money directly to people, like a continued expanded child tax credit, but others would fund programs that would take time to ramp up, like universal prekindergarten.Economists say the net result is likely to be at most a tenth of a percentage point or two increase in the inflation rate. That would be a relatively small effect at a time when supply chain crunches, surging global oil demand and a pandemic shift among consumers away from travel and dining out and toward durable goods have combined to raise the annual inflation rate to 6.8 percent, its fastest pace in nearly 40 years.For months, Mr. Manchin has warned the president and congressional leaders that he was uncomfortable with the breadth of what had become a $2.2 trillion bill to fight climate change, continue monthly checks to parents, establish universal prekindergarten and invest in a wide range of spending and tax cuts targeting child care, affordable housing, home health care and more. He has cited both the risks of inflation and his fear that the package could further balloon the federal budget deficit, saying several programs that are now estimated to end in a few years would likely be made permanent.Over the past week, he has insisted that the bill shrink to fit the framework of less than $2 trillion that Mr. Biden announced this fall, and that — crucially — the legislation not use budget gimmicks to artificially lower the bill’s effect on the budget deficit.In a statement on Sunday, Mr. Manchin said Democrats “continue to camouflage the real cost of the intent behind this bill.”White House officials have tried to promote the idea that the bill would reduce price pressures right away — an outcome economists have not entirely bought into. But the general economic consensus finds little evidence to suggest the bill risks exacerbating rising food, gasoline and other prices.Today’s inflationary surge stems from a confluence of factors, many of them related to the pandemic. The coronavirus has caused factories to shutter and clogged ports, disrupting the supply of goods that Americans stuck at home have wanted to buy, like electronics, televisions and home furnishings.That high demand has been fueled in part by consumers who are flush with cash after months of lockdown and repeated government payments, including stimulus checks. Research from the Federal Reserve has shown that inflation is most likely getting a temporary increase from the coronavirus relief package in March, which included $1,400 direct checks to families and generous unemployment benefits. But Mr. Biden’s social policy bill would do relatively little to spur increased consumer spending next year and not enough to offset the loss of government stimulus to the economy as pandemic aid expires.White House aides have tried to make that case to Mr. Manchin — and the public — in recent weeks, pointing to a series of analyses that have dismissed inflationary fears pegged to the bill. That includes analysis from a pair of Democratic economists who warned about rising inflation earlier this year — Harvard’s Lawrence H. Summers and Jason Furman — and from the nonpartisan Penn Wharton Budget Model at the University of Pennsylvania.     For years, environmentalists have sought compromises with labor unions in industries reliant on fossil fuels, aware that one of the biggest obstacles to cutting carbon emissions is opposition from the unions’ members.States like Washington, New York and Illinois have enacted renewable-energy laws that were backed by unions representing workers who build and maintain traditional power plants. And unions for electricians and steelworkers are rallying behind President Biden’s climate and social policy legislation, now in the Senate’s hands.But at least one group of workers appears far less enthusiastic about the deal-making: coal workers, who continue to regard clean-energy jobs as a major risk to their standard of living.“It’s definitely going to pay less, not have our insurance,” Gary Campbell, a heavy-equipment operator at a coal mine in West Virginia, said of wind and solar jobs. “We see windmills around us everywhere. They’re up, then everybody disappears. It’s not consistent.”Mr. Biden has sought to address the concerns about pay with subsidies that provide incentives for wind and solar projects to offer union-scale wages. His bill includes billions in aid, training money and redevelopment funds that will help coal communities.But Phil Smith, the top lobbyist for the United Mine Workers of America, said a general skepticism toward promises of economic relief was nonetheless widespread among his members. “We’ve heard the same things over and over and over again going back to J.F.K.,” Mr. Smith said. While there are fewer than 50,000 unionized coal miners in the country, compared with the millions of industrial and construction workers who belong to unions, miners have long punched above their weight thanks to their concentration in election battleground states like Pennsylvania or states with powerful senators, like Joe Manchin III of West Virginia.When Mr. Manchin, a Democrat and one of the chamber’s swing votes, came out against Mr. Biden’s $150 billion clean electricity program in October, his move effectively killed what many environmentalists considered the most critical component of the president’s climate agenda. (Some, like equipment operators, have more transferable skills.)It is also difficult to overstate the political gamesmanship that has shaped the discourse on miners. In her 2016 presidential campaign, Hillary Clinton proposed spending $30 billion on economic aid for coal country. But a verbal miscue — “We’re going to put a lot of coal miners and coal companies out of business,” she said while discussing her proposal at a town hall — allowed opponents to portray her as waging a “war on coal.”“It is a politicized situation in which one political party that’s increasingly captured by industry benefits from the status quo by perpetuating this rhetoric,” said Matto Mildenberger, a political scientist at the University of California, Santa Barbara, who studies the politics of climate policy.And then there is Mr. Manchin, a complicated political figure who is among the Senate’s leading recipients of campaign money from the fossil fuel industry.Mr. Manchin has sometimes resisted provisions favored by the miners’ union, such as wage-replacement payments to coal workers who must accept a lower-paying job. “At the end of the day, it wasn’t something he was interested in doing,” said Mr. Smith, the union’s lobbyist. A spokeswoman for Mr. Manchin declined to comment.Yet in other ways Mr. Manchin has channeled his constituents’ feelings well, suggesting that he might be more enthusiastic about renewable-energy legislation if they were.At a forum in the spring, he talked about the tendency to forget coal miners — “We feel like the returning Vietnam veteran,” he said — and questioned the proposed trade of “the traditional jobs we’re about to lose, for the transitional jobs that I’m not sure are going to be there.”In interviews, coal workers said they were skeptical that Mr. Biden’s spending plan would ultimately benefit them. The legislation allocated hundreds of millions of dollars to accelerate the transition from fossil fuels to renewable energy, and ensures that construction workers will receive union-scale wages on most nonresidential projects. It also includes tens of millions of dollars for worker training.But Doris Turner, a Democratic state senator from central Illinois whose district includes a coal-powered plant and mine workers, said she had voted “present” rather than “yea” on the bill because of lingering concerns about workers.Ms. Turner, a first-term senator who helped win a concession to extend the life of the local coal plant, said she sometimes felt like the Joe Manchin of Illinois. “I’m trying to build relationships with new colleagues, and all of a sudden here we are with this energy legislation and I’m like, ‘I can’t do that,’” Ms. Turner said. “Nobody was very rude, but I could hear sighs.”Pat Devaney, the secretary-treasurer of the Illinois A.F.L.-C.I.O., who was involved in negotiating the bill, said coal workers presented the most vexing policy dilemma.“That one is a little bit tougher of a nut to crack,” he said, adding that the A.F.L.-C.I.O. and other labor groups would continue to push for proposals like health benefits and lost-wage compensation for displaced workers, programs that didn’t make it into the recently enacted Illinois law.Such delays in economic relief are typical and have heightened miners’ opposition to clean-energy legislation, said Heidi Binko, executive director of the Just Transition Fund, a nonprofit group focused on growing local economies hit hard by the decline of fossil fuels.Ms. Binko cited the example of the Obama administration, which in 2014 proposed an ambitious regulatory effort to reduce carbon emissions that appeared likely to accelerate the closing of coal-fired plants. The administration later unveiled an economic development package for coal country — after voters there had already become alarmed.“It would have been received so differently if first the administration had done something to help the people left behind,” Ms. Binko said.Private philanthropists have often reinforced the problem, Ms. Binko said, by spending millions on campaigns to shut down coal plants, but little on economic development that would ease the political opposition to renewable energy in states like West Virginia.Carrie Doyle, a senior fellow in the environment program of the William and Flora Hewlett Foundation, which makes grants to organizations working on climate change, said philanthropists were only beginning to address the shortfall in funding for economic development.“It feels like it should have been put into place a while ago,” Ms. Doyle said. “Some of that funding is happening now, but it needs to scale.”While such efforts will come too late to ease the passage of Mr. Biden’s climate legislation, they could be essential to ensuring that renewable energy remains politically viable.Some scholars point to international trade as a cautionary tale. In the 1990s and 2000s, Congress approved multiple trade deals. Economists argued, as they do on renewable energy today, that the benefits to the country would far outweigh the costs, which would be concentrated among a small group of workers who could be compensated for their losses, or find new jobs for similar pay.But the failure to ease the economic blow to manufacturing workers, who many economists now concede were devastated by greater trade with China, helped unravel political support for free trade. In 2016, both major presidential nominees campaigned against the 12-nation trade pact that the Obama administration had spent years negotiating.If displaced fossil fuel workers go through a comparable experience, these scholars say, the political effects could be similar, unraveling support for climate policies.“There are lessons to be learned from that experience,” said Dr. Tingley, speaking of the fallout from trade.
