    Strike Threat on Freight Railroads Is New Supply Chain Worry

    Administration officials are pushing for a settlement to head off a walkout by tens of thousands of workers on Friday.Biden administration officials are racing to prevent a strike by tens of thousands of freight railroad workers that could further disrupt an already strained supply chain and cause billions of dollars in economic damage.The industry failed to reach a contract agreement with two unions representing much of the work force, and a federally mandated 30-day “cooling off” period ends on Friday, opening a door to strikes and lockouts. Some freight companies have started to limit services, and Amtrak, which carries many travelers on lines operated by freight railroads, said it would cancel some passenger service starting on Tuesday.Labor Secretary Martin J. Walsh pressured both sides over the weekend to reach an agreement, and administration officials have held dozens of calls with the industry and the unions, according to the Labor Department.“All parties need to stay at the table, bargain in good faith to resolve outstanding issues and come to an agreement,” the department said in a statement. “The fact that we are already seeing some impacts of contingency planning by railways again demonstrates that a shutdown of our freight rail system is an unacceptable outcome for our economy and the American people, and all parties must work to avoid that.”The deadlock puts President Biden in a complicated position. His administration has taken pains to restore and fortify the supply chain, which was deeply disrupted by the coronavirus pandemic. It has also worked hard to protect and endorse union rights.“A strike doesn’t help anybody,” Mr. Walsh said in an interview late last month. “A strike doesn’t help the workers. A strike doesn’t help the general public. A strike certainly doesn’t help the supply chain.”In July, Mr. Biden established an emergency board to help mediate the dispute between the industry, which includes six of the largest freight rail carriers, and about a dozen unions. Last month, that board recommended a resolution with a cumulative raise of 24 percent from 2020 through 2024, including an immediate 14 percent wage increase covering the first three years.Most of the unions agreed to the proposal, pending a vote of their membership. But two major unions are holding out for improvements to working conditions, which they say have steadily worsened in recent years as rail carriers have cut staffing.The Brotherhood of Locomotive Engineers and Trainmen and the SMART Transportation Division, which represent engineers and conductors, say workers must often stay on call for several days at a time, working 12-hour shifts with little notice, and are penalized for calling in sick.“Our unions remain at the bargaining table and have given the rail carriers a proposal that we would be willing to submit to our members for ratification, but it is the rail carriers that refuse to reach an acceptable agreement,” they said in a joint statement. “In fact, it was abundantly clear from our negotiations over the past few days that the railroads show no intentions of reaching an agreement with our unions.”Inflation F.A.Q.Card 1 of 5What is inflation?     Global Shipping Delays Loom Over Retailers for the Holidays

    The travails of a Chicago fishing company’s advent calendar highlight the supply chain hurdles for businesses trying to deliver items in time for the holidays.WASHINGTON — It was 73 days until Christmas, and the clock was ticking down for Catch Co.The Chicago-based fishing company had secured a spot to sell a new product, an advent calendar for fishing enthusiasts dubbed “12 Days of Fishmas,” in 2,650 Walmart stores nationwide. But like so many products this holiday season, the calendars were mired in a massive traffic jam in the flow of goods from Asian factories to American store shelves.With Black Friday rapidly approaching, many of the calendars were stuck in a 40-foot steel box in the yard at the Port of Long Beach, blocked by other containers stuffed with toys, furniture and car parts. Truckers had come several times to pick up the Catch Co. container but been turned away. Dozens more ships sat in the harbor, waiting their turn to dock. It was just one tiny piece in a vast maze of shipping containers that thousands of American retailers were trying desperately to reach.“There’s delays in every single piece of the supply chain,” said Tim MacGuidwin, the company’s chief operations officer. “You’re very much not in control.”Catch Co. is one of the many companies finding themselves at the mercy of global supply chain disruptions this year. Worker shortages, pandemic shutdowns, strong consumer demand and other factors have come together to fracture the global conveyor belt that shuffles consumer goods from Chinese factories, through American ports and along railways and freeways to households and stores around the United States.American shoppers are growing nervous as they realize certain toys, electronics and bicycles may not arrive in time for the holidays. Shortages of both finished products and components needed to make things like cars are feeding into rising prices, halting work at American factories and dampening economic growth.The disruptions have also become a problem for President Biden, who has been vilified on Fox News as “the Grinch who stole Christmas.”The White House’s supply chain task force has been working with private companies to try to speed the flow of goods, even considering deploying the National Guard to help drive trucks. But the president appears to have limited power to alleviate a supply chain crisis that is both global in nature and linked to much larger economic forces that are out of his control. On Sunday, Mr. Biden met with other world leaders at the Group of 20 in Rome to discuss supply chain challenges.On Oct. 13, the same day that Catch Co. was waiting for its calendars to clear the port, Mr. Biden announced that the Port of Los Angeles and companies like FedEx and Walmart would move toward around the clock operations, joining the Port of Long Beach, where one terminal had begun staying open 24 hours just weeks before.Shipping containers stacked up at the Port of Long Beach in California in October. Allison Zaucha for The New York Times“This is a big first step in speeding up the movement of materials and goods through our supply chain,” Mr. Biden said. “But now we need the rest of the private sector chain to step up as well.”Mr. MacGuidwin praised the announcement but said it had come too late to make much difference for Catch Co., which had been working through supply chain headaches for many months.The company’s problems first began with the pandemic-related factory shutdowns in China and other countries, which led to a shortage in the graphite used to make fishing poles. A worldwide scramble for shipping containers soon followed, as Americans began spending less on movies, travel and restaurants, and more on outfitting their home offices, gyms and playrooms with products made in Asian factories.Shipping rates soared tenfold, and big companies turned to extreme measures to deliver their goods. Walmart, Costco and Target began chartering their own ships to ferry products from Asia and hired thousands of new warehouse employees and truck drivers.Smaller companies like Catch Co. were struggling to keep up. As soon as Apple launched a new iPhone, for example, the available shipping containers vanished, diverted to ship Apple’s products overseas.The timing could not have been worse for Catch Co., which was seeing demand for its poles, lures and other products surge, as fishing became an ideal pandemic hobby. The company turned briefly to air freighting products to meet demand, but at five or six times the cost of sea freight, it cut into the company’s profits.The supply chain woes became an even bigger problem for Catch Co.’s “12 Days of Fishmas” calendar, which featured the company’s plastic worms, silver fish hooks and painted lures hiding behind cardboard windows. The calendar, which retails for $24.98, was a “big deal” for the company, Mr. MacGuidwin said. It would account for more than 15 percent of the company’s holiday sales and introduce customers to its other products. But it had an expiration date: Who would buy an advent calendar after Christmas?Mr. MacGuidwin thought briefly about storing late arrivals for next year before realizing the calendar said “2021.”Catch Co. had secured a spot to sell a new product, an advent calendar dubbed “The 12 Days of Fishmas,” in 2,650 Walmart stores nationwide.Chase Castor for The New York TimesBoxes of the calendars were prepared for distribution in Kansas City.Chase Castor for The New York Times“It cannot be sold after Christmas,” he said. “It is a scrapped product after that.”Like many American companies, Catch Co. had tried to prepare for the global delays.The Chinese factories the company works with began manufacturing the calendar in April, before Walmart had even confirmed its orders. On July 10, the calendars were shipped to the port at Qingdao. But a global container shortage kept the calendars idling at the Chinese port for a month, awaiting for a box to be shipped in.On Sept. 1, nearly three weeks after setting sail across the Pacific Ocean, the vessel anchored off the coast of Southern California, alongside 119 other ships vying to unload. Two weeks later Catch Co.’s containers were off the ship, where they descended into the maze of boxes at the Port of Long Beach.Inside the BoxThe twin ports of Long Beach and Los Angeles — which together process 40 percent of the shipping containers brought into the United States — have struggled to keep up with the surge in imports for many months.Together, the Southern California ports handled 15.3 million 20-foot containers in the first nine months of the year, up about a quarter from last year. Dockworkers and truckers had worked long hours throughout the pandemic. More than 100 trains, each at least three miles long, were leaving the Los Angeles basin each day.But by this fall, the ports and warehouses of Southern California were so overstuffed that many cranes at the port had actually come to a standstill, without space to store the containers or truckers to ferry them away.On Sept. 21, the Port of Long Beach announced that it had started a trial to keep one terminal open around the clock. A few weeks later, at Mr. Biden’s urging and with the support of various unions, the Port of Los Angeles and Union Pacific’s nearby California facility joined in.So far, few truckers have arrived during the expanded hours. The ports have pointed to bottlenecks in other parts of the supply chain — including a shortage of truckers and overstuffed warehouses that can’t fit more products through their doors.“We are in a national crisis,” said Mario Cordero, the executive director of the port of Long Beach. “It’s going to be an ongoing dynamic until we have full control of the virus that’s before us.”Worker shortages at warehouses have led to delays.Chase Castor for The New York TimesTruckers, who have worked long hours throughout the pandemic, are also in short supply.Chase Castor for The New York TimesIn the past, Catch Co. would often ship products from West Coast ports by rail. But longer travel times on rail lines — as well as the high demand for containers at Chinese ports — mean shipping companies have been loath to let their containers stray too far from the ocean.So instead, the Catch Co. calendars were moved by truck to a warehouse outside the port owned by freight forwarder Flexport. There, they were placed on another truck to be shipped to Catch Co.’s Kansas City distribution center, where workers would repack the calendars for Walmart. Mr. MacGuidwin estimated that the calendars would arrive in Walmart stores by Nov. 17 — just in time for Black Friday. The calendar’s entire trip from factory to store shelves would take about 130 days this year, compared with the typical 60.Mr. MacGuidwin said he believes supply chain difficulties may ease next year, as ports, rails and trucking companies gradually work through their backlogs. Asia remains the best place to manufacture many of their goods, he said. But if shipping costs remain high and disruptions continue, they may consider sourcing more products from the United States and Latin America.Catch Co. has already started designing its calendar for next year and is still deciding whether it should say “2022.”“It’s an open question,” said Mr. MacGuidwin.     $1 Trillion Infrastructure Bill Pours Money Into Long-Delayed Needs

    The sprawling, 2,702-page bill includes historic investments in traditional projects as well as broadband expansion and funds for some climate projects.WASHINGTON — Amtrak would see its biggest infusion of money since its inception a half-century ago. Climate resilience programs would receive their largest burst of government spending ever. The nation’s power grid would be upgraded to the tune of $73 billion.The sprawling, $1 trillion bill that the Senate took up on Monday — a 2,702-page bipartisan deal that is the product of months of negotiating and years of pent-up ambitions to repair the nation’s crumbling infrastructure — would amount to the most substantial government expenditure on the aging public works system since 2009.It is also stuffed with pet projects and priorities that touch on nearly every facet of American life, including the most obscure, like a provision to allow blood transport vehicles to use highway car pool lanes to bypass traffic when fresh vials are on board and another to fully fund a federal grant program to promote “pollinator-friendly practices” near roads and highways. (Price tag for the latter: $2 million per year.)The measure represents a crucial piece of President Biden’s economic agenda, and the agreement that gave rise to it was a major breakthrough in his quest for a bipartisan compromise. But it was also notable for the concessions Mr. Biden was forced to make to strike the deal, including less funding for clean energy projects, lead pipe replacement, transit and measures targeted to historically underserved communities.Some of those provisions could be included in Democrats’ budget blueprint, expected to amount to $3.5 trillion, which they plan to take up after completing the infrastructure bill and push through unilaterally over Republican objections.The infrastructure legislation, written by a group of 10 Republicans and Democrats, could still change in the coming days, as other senators eager to leave their imprint have a chance to offer proposals for changes. The Senate began considering amendments on Monday, with more possible in the coming days.But the legislation marks a significant bipartisan compromise, including $550 billion in new funds and the renewal of an array of existing transportation and infrastructure programs otherwise slated to expire at the end of September.For climate, a substantial investment that falls short of the administration’s goals.As states confront yet another consecutive year of worsening natural disasters, ranging from ice storms to wildfires, the measure includes billions of dollars to better prepare the country for the effects of global warming and the single largest federal investment in power transmission in history.Much of the money intended to bolster the country’s ability to withstand extreme weather would go toward activities that are already underway, but which experts say the government needs to do more of as the threats from climate change increase. It also would support new approaches, including money for “next-generation water modeling activities” and flood mapping at the National Oceanic and Atmospheric Administration, which would also receive funds to predict wildfires.The legislation also includes $73 billion to modernize the nation’s electricity grid, which energy analysts said would lay the groundwork for pivoting the nation off fossil fuels. But it contains only a fraction of the money Mr. Biden requested for major environmental initiatives and extends a lifeline to natural gas and nuclear energy, provisions that have angered House progressives.There is also $7.5 billion for clean buses and ferries, but that is not nearly enough to electrify about 50,000 transit buses within five years, as Mr. Biden has vowed to do. The bill includes $7.5 billion to develop electric vehicle charging stations across the country, only half of the $15 billion Mr. Biden requested to deliver on his campaign pledge of building 500,000 of them.The bill would provide $15 billion for removing lead service lines across the nation, compared with the $45 billion Mr. Biden had called for and the $60 billion water sector leaders say is needed to get the job done.The legislation also includes more than $300 million to develop technology to capture and store carbon dioxide emissions from power plants, and $6 billion to support struggling nuclear reactors. It directs the secretary of energy to conduct a study on job losses associated with Mr. Biden’s decision to cancel the Keystone XL Pipeline.The legislation includes $73 billion to modernize the nation’s electricity grid.Jim Wilson/The New York TimesSenators won pet projects and crucial funding for their favored priorities.As one of the few major bills likely to be enacted during this Congress, the infrastructure measure has become a magnet for lobbying by industries across the country — and by the lawmakers whose votes will be needed to push it through, many of whom spent Monday highlighting funds for their top priorities.For the quartet of senators who represent the legions of federal workers who use the Washington Metro — Senators Tim Kaine and Mark Warner of Virginia, and Benjamin L. Cardin and Chris Van Hollen of Maryland, all Democrats — there was a critical annual reauthorization of $150 million for the transit system over a decade.The legislation would authorize funding to reconstruct a highway in Alaska, the home state of Senator Lisa Murkowski, a key Republican negotiator. Special funds are set aside for the Appalachian Regional Commission, a federal economic development body whose co-chairwoman is Gayle Manchin, the wife of Senator Joe Manchin III of West Virginia, one of the bill’s principal authors and a key Democratic swing vote. Mr. Manchin also helped secure funds to clean up abandoned mine lands in states like his.The legislation would set aside funds for individual projects across the country, including $1 billion for the restoration of the Great Lakes, $24 million for the San Francisco Bay, $106 million for the Long Island Sound and $238 million for the Chesapeake Bay.It also includes $66 billion in new funding for rail to address Amtrak’s maintenance backlog, along with upgrading the high-traffic Northeast Corridor from Washington to Boston. For Mr. Biden, an Amtrak devotee who took an estimated 8,000 round trips on the line, it is a step toward fulfilling his promise to inject billions into rail.Unspent pandemic funds and tougher scrutiny of cryptocurrency help pay for the plan.With Republicans and some moderate Democrats opposed to adding to the nation’s ballooning debt, the legislation includes a patchwork of financing mechanisms, though some fiscal hawks have called many of them insufficient.To pay for the legislation, lawmakers have turned partly to $200 billion in unused money from previous pandemic relief programs enacted in 2020.That includes $53 billion in expanded jobless benefit money that can be repurposed since the economy recovered more quickly than projections assumed, and because many states discontinued their pandemic unemployment insurance payments out of concern that the subsidies were dissuading people from rejoining the work force.The bill claws back more than $30 billion that was allocated — but had not been spent — for a Small Business Administration disaster loan program, which offers qualified businesses low-interest loans and small grants. That program has been stymied by shifting rules and red tape, and has disbursed cash far more slowly than Congress (and many applicants) expected.Leftover funds from other defunct programs would also be reprogrammed. That includes $3 billion never deployed in relief funds for airline workers.Marc Goldwein of the Center for a Responsible Federal Budget said that only about $50 billion of the estimated $200 billion represented real cost savings. The rest, he said, amounted to “cherry picking” numbers and claiming savings from projected costs that did not transpire.An analysis of the legislation by the congressional Joint Committee on Taxation estimated that the legislation could raise $51 billion in revenue over a decade, while the Congressional Budget Office is expected to release projections on its overall cost as early as this week.The legislation also includes tougher scrutiny by the I.R.S. on cryptocurrency. But a last-minute lobbying push by the industry to water down the language succeeded, resulting in a scaling back of the new requirements.Still, the provision is projected to raise $28 billion over a decade.New resources for underserved communities — but far fewer than the president wanted.As the United States remains battered by both the toll of the coronavirus pandemic and an onslaught of wildfires, droughts, floods and other weather calamities, the legislation seeks to target its support toward underserved communities historically in need of additional federal support.But while Mr. Biden had called for $20 billion for projects designed to help reconnect Black neighborhoods and communities of color splintered or disadvantaged by past construction, the legislation includes just $1 billion, half of which is new federal funding, over five years for the program. The legislation also creates a new $2 billion grant program to expand roads, bridges and other surface transportation projects in rural areas.The bill would increase support for tribal governments and Native American communities, creating an office within the Department of Transportation intended to respond to their needs. It would provide $216 million to the Bureau of Indian Affairs for climate resilience and adaptation for tribal nations, which have been disproportionately hurt by climate change. More than half of that money, $130 million, would go toward “community relocation” — helping some Native communities move away from vulnerable areas.It would also help improve access to running water and other sanitation needs in tribal communities and Alaska Native villages, with lawmakers determined to take care of all existing project needs.“We are still in an extreme deficit when it comes to our tribal communities,” Ms. Murkowski said in a speech on the Senate floor, adding that the funding level was “unprecedented.” “We’ve got to do right by our Native people.”A major investment in closing the digital divide.Alongside old-fashioned public works projects like roads, bridges and highways, senators have included $65 billion meant to connect hard-to-reach rural communities to high-speed internet and help sign up low-income city dwellers who cannot afford it. Other legal changes seek to stoke competition and transparency among service providers that could help drive down prices.Official estimates vary, but most suggest that tens of millions of Americans lack reliable access to high-speed internet, many of them people of color, members of rural communities or other low-income groups. That need, lawmakers said, was exacerbated by lockdowns during the pandemic that required work and schooling from home.Mr. Biden had initially proposed $100 billion to try to bring that number to zero, but he agreed to lower the price to strike a compromise with Republicans. Democrats also fought to secure the inclusion of legislation to encourage states to develop comprehensive plans to ensure that access to high-speed internet is distributed equitably among traditionally underserved groups and educate them about access to digital resources.Nicholas Fandos More
