That was up from 4.3 million in August and was the most in the two decades the government has been keeping track. Nearly a million quit their jobs in the leisure and hospitality industry alone, reflecting the steep competition for workers there as businesses recover from last year’s pandemic-induced shutdowns.There were 10.4 million job openings in the United States at the end of September. That is down a bit from the record 11.1 million posted in July, before the spread of the Delta variant of the coronavirus led to a slump in sales in some businesses. But demand for labor remains extraordinarily high by historical standards — before the pandemic, the record for job openings in a month was 7.6 million in November 2018. The Labor Department revised its estimate of job openings in August to 10.6 million.There were roughly 75 unemployed workers for every 100 job openings in September, the lowest ratio on record. At the same time, understaffing in many businesses may be putting stress on remaining workers, leading even more people to leave their jobs. Industries that require most employees to work in person, such as manufacturing, retail and health care — as well as leisure and hospitality — report the biggest increases in the rate of workers leaving their jobs.“We are seeing big pickups in quits in the industries that are having the hardest time hiring right now,” said Nick Bunker, director of economic research for the job site Indeed.Kaylie Sweeting worked as a bartender in Millburn, N.J., through most of the pandemic, despite concerns about interacting with unmasked customers and frustration about low wages. But when the restaurant pressured a colleague to come to work sick this summer, Ms. Sweeting quit.“The job was absolutely no longer worth it,” she said. “I was hurt that a company that I gave my time to did not seem to prioritize me or my safety.”So Ms. Sweeting, 23, and her partner, a cook, decided to take the money they had saved to buy a house and open their own vegan restaurant instead. They recently signed a lease and are beginning renovations, with plans to open early next year. They are trying to apply the lessons they have learned as employees, promising good wages, paid time off and other basic benefits that restaurant jobs have often failed to provide.“I genuinely love the industry,” Ms. Sweeting said. “I just don’t love the way it’s managed. I feel like the only way to change it is to implement the change yourself.” More

    The Biggest Kink in America’s Supply Chain: Not Enough Truckers

    WASHINGTON — Facing more than $50,000 in student debt, Michael Gary dropped out of college and took a truck driving job in 2012. It paid the bills, he said, and he could reduce his expenses if he lived mostly out of a truck.But over the years, the job strained his relationships. He was away from home for weeks at a time and could not prioritize his health: It took more than three years to schedule an optometry appointment, which he kept canceling because of his irregular work hours. He quit on Oct. 6.“I had no personal life outside of driving a truck,” said Mr. Gary, 58, a resident of Vancouver, Wash. “I finally had enough.”Truck drivers have been in short supply for years, but a wave of retirements combined with those simply quitting for less stressful jobs is exacerbating the supply chain crisis in the United States, leading to empty store shelves, panicked holiday shoppers and congestion at ports. Warehouses around the country are overflowing with products, and delivery times have stretched to months from days or weeks for many goods.A report released last month by the American Trucking Associations estimated that the industry is short 80,000 drivers, a record number, and one the association said could double by 2030 as more retire.Supply-chain problems stem from a number of factors, including an extraordinary surge in demand for goods and factory shutdowns abroad. But the situation has been compounded by a shortage of truckers and deteriorating conditions across the transportation sector, which have made it even harder for consumers to get the things they want when they want them.The phenomenon is rippling across the economy, weighing on growth, pushing up prices for consumers and depressing President Biden’s approval rating. But the White House has struggled with how to respond.On Tuesday, it announced a series of steps aimed at alleviating supply-chain problems, such as allowing ports to redirect other federal funds to efforts to ease backlogs. As part of the plan, the Port of Savannah could reallocate more than $8 million to convert existing inland facilities into five pop-up container yards in Georgia and North Carolina to help ships offload cargo more quickly.That followed an announcement by Mr. Biden last month that major ports and private companies would begin moving toward 24-hour operation in an effort to ease the gridlock. But early results suggest that trucking remains a major bottleneck in that effort, compounding congestion at the ports.The directors of the ports of Los Angeles and Long Beach said that, at least initially, few additional truckers were showing up to take advantage of the extended hours.Gene Seroka, the executive director of the Port of Los Angeles, said his port had told the White House in July that about 30 percent of the port’s appointments for truckers went unused every day, largely because of shortages of drivers, the chassis they use to pull the loads and warehouse workers to unload items from trucks.“Here in the port complex, with all this cargo, we need more drivers,” Mr. Seroka said.The $1 trillion infrastructure bill that the House passed last week could help mitigate the shortage. The legislation includes a three-year pilot apprenticeship program that would allow commercial truck drivers as young as 18 to drive across state lines. In most states, people under 21 can receive a commercial driver’s license, but federal regulations restrict them from driving interstate routes.But industry experts said the program was unlikely to fix the immediate problem, given that it could take months to get underway and the fact that many people simply do not want to drive trucks.Mr. Biden said last month that he would consider deploying the National Guard to alleviate the trucker shortage, although a White House official said the administration was not actively pursuing the move.Meera Joshi, the deputy administrator of the Federal Motor Carrier Safety Administration, said the agency had focused on easing the process of obtaining a commercial driver’s license after states cut back licensing operations during the coronavirus pandemic. The agency has also extended the hours that certain drivers can work. “They are the absolute backbone of a big part of our supply chain,” Pete Buttigieg, the transportation secretary, said about truckers at a White House briefing on Monday. “We need to respect and, in my view, compensate them better than we have.”The shortage has alarmed trucking companies, which say there are not enough young people to replace those aging out of the work force. The stereotypes attached with the job, the isolating lifestyle and younger generations’ focus on pursuing four-year college degrees have made it difficult to entice drivers. Trucking companies have also struggled to retain workers: Turnover rates have reached as high as 90 percent for large carriers.In response, the companies have raised their wages. The average weekly earnings for long-distance drivers have increased about 21 percent since the start of 2019, according to the Bureau of Labor Statistics. Jon Gold, the vice president of supply chain and customs policy at the National Retail Federation, said the driver shortage has contributed to steeper costs for retailers, which are trickling down to consumers and pushing up some of the prices at stores.“We are seeing cost increases at every step of the way in the transportation supply chain,” Mr. Gold said. “From ocean to truck to rail, costs are increasing.”Derek J. Leathers, the president and chief executive of Werner Enterprises in Omaha, which employs about 9,500 drivers, said its services cost about 15 percent more than prepandemic levels as driver salaries and equipment costs have climbed.The company is trying to hire about 700 truck drivers — up from about 300 before the pandemic — after demand swelled and retirements left the company short on workers.     Retailers Scramble to Attract Workers Ahead of the Holidays

    Signing bonuses, higher wages, even college tuition. Companies are using perks to entice new employees in an industry that has been battered by the pandemic.Macy’s is offering referral bonuses of up to $500 for each friend or family member that employees recruit to join the company. Walmart is paying as much as $17 an hour to start and has begun offering free college tuition to its workers. And some Amazon warehouse jobs now command signing bonuses of up to $3,000.Retailers, expecting the holiday shopping season to be bustling once again this year after being upended by the coronavirus in 2020, are scrambling to find enough workers to staff their stores and distribution centers in a tight labor market. It is not proving easy to entice applicants to an industry that has been battered, more than most, by the pandemic’s many challenges, from fights over mask wearing to high rates of infection among employees. Willing retail workers are likely to earn larger paychecks and work fewer hours, while consumers may be greeted by less inventory and understaffed stores.“Folks looking to work in retail have typically had very little choice — it’s largely been driven by geography and availability of hours,” said Mark A. Cohen, the director of retail studies at Columbia University’s business school. “Now they can pick and choose who’s got the highest, best benefits, bonuses and hourly rates. And as we’ve seen, the escalation has been striking.”Or as Jeff Gennette, the chief executive of Macy’s, which plans to hire 76,000 full- and part-time employees this season, put it in a recent interview: “Everyone’s experiencing this — there’s a war for talent at the front lines. My sense is we all have to raise our game.”While some of the most generous perks, like tuition reimbursement, are being offered mainly to long-term workers, even seasonal workers will see higher pay than usual. It’s especially critical for retailers to hire temporary help this year because existing employees are already strained from nearly two years of pandemic conditions. The work force is tired out.”Mr. Mushkin experienced firsthand just how eager retailers are for workers during a visit last month to a Home Depot in Naperville, Ill.“I was looking at a sign listing open positions at the store when I was basically accosted by a manager asking if I was interested in applying,” Mr. Mushkin said.Mr. Mushkin said he was struck not only by the manager’s desperation but also by the number of positions available. “Basically every job in that store is open,” he said. “So who is doing those jobs now? Who is picking up the slack?”Those pressures may explain why large retailers like Walmart are looking to hire 150,000 additional workers to supplement its current staff this season. For several years leading up to the pandemic, Walmart offered existing workers extra hours at the holidays but did not start a large hiring blitz. (Existing employees can still sign up for additional hours.) With giant retailers gobbling up many of the job candidates, enticing new employees is that much harder for others.Many retailers, like Saks Off 5th, reiterated commitments to remain closed on Thanksgiving this year, a welcome shift for workers after a yearslong trend of shopping invading the holiday. Demanding that employees work in stores that day would probably be a particularly tough sell this year.Nordstrom, which is aiming to hire 28,600 seasonal and regular employees, said it had increased bonus and incentive pay to as much as $650 for hourly and overnight store workers, from as much as $400 last year.Saks Off 5th said in October that it was raising its minimum base wage for hourly store workers to $15 per hour — more than double the federal minimum wage — and that it would not offer extended holiday shopping hours this year so that staff could have more flexibility.Best Buy is allowing job applicants to submit videos rather than coming in physically for a first round of interviews, saying in a recent statement that the videos “can be recorded and reviewed without the need to go back and forth on scheduling.”The scramble by retailers comes as the American economy is gaining strength, adding 531,000 jobs in October, a sharp rebound from the previous month. But even as unemployment dropped to 4.6 percent from 4.8 percent, the labor participation rate — which measures the share of the working-age population employed or looking for a job — was flat last month, at 61.6 percent. That signals that the pool of available workers remains tight.“We’re coming out of a crisis we have no experience in dealing with, in which millions of people were furloughed or laid off or removed from the work force, and to think they’ll all show up on certain date to come back to work is kind of silly,” Mr. Cohen said. “Some people are still fearful about coming back to work, especially in a job in which they would be exposed to large numbers of the public.”While fear of the Delta variant may be keeping some workers away, the retail industry had been loath to impose vaccine mandates for fear that store workers might leave and that it might become even harder to find seasonal employees. A new vaccinate-or-test requirement for companies with 100 or more employees announced by the Biden administration on Thursday essentially forced their hands, though it is not scheduled to take effect until Jan. 4 and was temporarily blocked on Saturday by a federal appeals court in Louisiana. (The mandate does instruct employers to require unvaccinated workers to wear masks by Dec. 5.)The National Retail Federation was critical of the mandate, saying it imposes “burdensome new requirements on retailers during the crucial holiday shopping season.”L.L. They were regularly exposed to Covid-19 and involved in customer conflicts around wearing masks, and they were inconsistently offered hazard pay or other compensation for their efforts. Many retail workers said that they were not properly informed when they were exposed to the virus in stores.Anthony Stropoli, a personal shopper at Bergdorf Goodman, holds one of the lucrative, client-facing jobs that have been fading in retail in recent years and he noted that luxury retail was a different ballgame. He previously worked at Barneys New York, which filed for bankruptcy in 2019.“A lot of people do not want to work in retail right now — I really, really see it,” Mr. Stropoli said. “People are not feeling appreciated or fairly compensated, and I think this whole Covid thing has made them really rethink that. They want to feel valued.”It all means that workers have more leverage this season than they have in the past.     Workers' Pay Is in a Tug of War With Inflation

    American workers are taking home bigger paychecks as employers pay up to attract and retain employees. But those same people are shelling out more for furniture, food and many other goods and services these days.It is not yet clear which side of that equation — higher pay or higher prices — is going to win out, but the answer could matter enormously for the Federal Reserve and the White House.There are a few ways this moment could evolve. Wage growth could remain strong, driven by a tight labor market, and overall inflation could simmer down as supply chain snarls unravel and a surge in demand for goods eases. That would benefit workers.But troubling outcomes are also possible, and high on the list of worries is what economists call a “wage-price spiral.” Employees could begin to demand higher pay because they need to keep up with a rising cost of living, and companies may pass those labor costs on to their customers, kicking off a vicious cycle. That could make today’s quick inflation last longer than policymakers expect.The stakes are high. One way to measure the dynamic is through the Employment Cost Index, which is reported by the Labor Department every quarter. In the year through September, the index’s measure of wages and salaries jumped by 4.2 percent. But an inflation gauge that tracks consumer prices rose by 5.4 percent over the same period.A different measure of pay, an index that tracks hourly earnings, did rise faster than inflation in August and September after lagging it for much of the year.And an update to that gauge, set for release in the jobs report on Friday, is expected to show that wages climbed 0.4 percent in October, which is roughly in line with recent monthly price increases. But the data on hourly earnings have been distorted by the pandemic, because low-wage workers who left the job market early in 2020 are now trickling back in, jerking the average around.The upshot is that the tug of war between price increases and pay increases has yet to decisively swing in workers’ favor.Whether wage gains eventually eclipse inflation — and why — will be crucial for economic policymakers. Central bankers celebrate rising wages when they come from productivity increases and strong labor markets, but would worry if wages and inflation seemed to be egging each other upward.The Federal Reserve is “watching carefully,” for a troubling increase in wages, its chair, Jerome H. Powell, said on Wednesday, though he noted that the central bank did not see such a trend shaping up.Recruiters do report some early signs that inflation is factoring into pay decisions. Bill Kasko, president of Frontline Source Group, a job placement and staffing firm in Dallas, said that as gas prices in particular rise, employees are demanding either higher pay or work-from-home options to offset their increased commuting costs.“It becomes a topic of discussion in negotiations for salary,” Mr. Kasko said.But for the most part, today’s wage gains are tied to a different economic trend: red-hot demand for workers. Job openings are high, but many would-be employees remain on the labor market’s sidelines, either because they have chosen to retire early or because child care issues, virus concerns or other considerations have dissuaded them from working.Emily Longsworth Nixon, 27 and from Dallas, is one of Mr. Kasko’s employees.     U.S. Economy Added 531,000 Jobs in October

    The American economy added 531,000 jobs in October, the Labor Department said Friday, a sharp rebound from the prior month and a sign that employers are feeling more optimistic as the latest coronavirus surge eases.Economists polled by Bloomberg had been looking for a gain of 450,000 jobs. The unemployment rate declined to 4.6 percent, from 4.8 percent.The October gain was an improvement from the 312,000 positions added in September — a number that was revised upward on Friday.Hiring has seesawed this year along with the pandemic, especially in vulnerable sectors like hospitality and retail, where workers must deal face to face with customers. White-collar employees have fared better, since many can work remotely.Some employers are complaining of a shortage of workers, as many people remain on the sidelines of the job market. At the same time, the labor shortage has given workers a measure of leverage they’ve not experienced in recent years.“For the last 25, maybe 30 years, labor has been on its back heels and losing its share of the economic pie,” said Mark Zandi, the chief economist at Moody’s Analytics. “But that dynamic is now shifting.”Supply chain problems are another headache for employers.     John Deere Says Contract That Workers Rejected Was Its Final Offer

    One day after workers at the agriculture equipment maker Deere & Company voted down a second contract proposal, the company said Wednesday that the proposal was its best and final offer and that it had no plans to resume bargaining.The rejection of the contract by roughly 10,000 workers extended a strike that began in mid-October, after workers based primarily in Iowa and Illinois voted down an earlier agreement negotiated by the United Automobile Workers union.The company confirmed its position in an email after it was reported by Bloomberg. A U.A.W. spokesman said only that the union’s negotiating team was continuing “to discuss next steps.”Marc A. Howze, a senior Deere official, said in a statement Tuesday night that the agreement would have included an investment of “an additional $3.5 billion in our employees, and by extension, our communities.”“With the rejection of the agreement covering our Midwest facilities, we will execute the next phase of our Customer Service Continuation Plan,” the statement continued, alluding to Deere’s use of salaried employees to run facilities where workers are striking.Many workers had complained that wage increases and retirement benefits included in the initial proposal were too weak given that the company — known for its distinctive green-and-yellow John Deere products — was on pace for a record of nearly $6 billion in annual profits.According to a summary produced by the union, wage increases under the more recent proposal would have been 10 percent this year and 5 percent in the third and fifth years.     How the Pandemic Has Added to Labor Unrest

    While big companies wield considerable power, Covid’s economic disruption has given workers new leverage, contributing to a recent upturn in strikes.When 420 workers at the Heaven Hill spirits bottling plant near Louisville went on strike in September, they were frustrated that the company’s proposed contract could reduce their overtime pay. Many had earned extra income working seven days a week during the pandemic.“We were essential,” said Leslie Glazar, recording secretary of the local union representing spirits workers. “They kept preaching, ‘You get us through that, we’ll make it worth your time.’ But we went from heroes to zero.”The recent strike at Heaven Hill, which ended in late October after the company softened its overtime proposal, appears to reflect the current moment: Buoyed by shortages in labor and supplies that leave employers more vulnerable, and frustrated by what they see as unfair treatment during the pandemic, workers are standing up for a better deal.Data collected by the School of Industrial and Labor Relations at Cornell University shows the number of workers on strike increased in October, to more than 25,000, versus an average of around 10,000 in the previous three months.“Labor market leverage and the fact that workers have been through incredibly difficult working conditions over the past year and a half with the pandemic are combining to explain a lot of this labor activism now,” said Johnnie Kallas, a Ph.D. student and the project director of Cornell’s Labor Action Tracker.Large companies continue to have considerable power, and it is not clear that the recent job actions point to a new era of widespread strikes. Many workers who were nearing a strike appear to have pulled back from the brink, including 60,000 film and television production workers, whose strike threat was at least temporarily defused when their union reached tentative agreements with production studios. And even a doubling or tripling of strike activity would fall well below levels common in the 1960s and 70s.But the fitful economic recovery from the pandemic has eroded management’s advantages. Employers are having unusual difficulty in filling jobs — this summer, the Labor Department recorded the highest number of job openings since it began keeping such data in 2000. And for some companies, supply-chain disruptions have taken a toll on the bottom line.In a recent survey by IPC, a trade association representing the electronics industry, nine out of 10 manufacturers complained that the time it takes to make their goods had increased. Deere workers hired after 1997 have much smaller traditional pensions.In some cases, workers have even grown skeptical of their union leadership, worrying that negotiators have become too remote from the concerns of the rank and file.This is particularly true at the United Automobile Workers, which has been wracked by a corruption scandal in which more than 15 people have been convicted, including two recent presidents. Nonunionized workers often find strikes harder to organize and harder to endure because of the lack of pay. They are typically more vulnerable to potentially unlawful responses by employers, which unions have the legal muscle to resist.It is perhaps no surprise that as the rate of union membership has fallen, so has the number of strikes. Until the early 1980s, the country typically saw more than 200 a year involving 1,000 or more workers, versus 25 in 2019, the highest in almost two decades. An analysis by the employment site ZipRecruiter showed that when the strike vote was taken in September, job postings in the Louisville area had increased by almost twice the percentage they had nationwide during the pandemic.After the company threatened to bring in replacement workers, the employees were dismissive. “No one can find workers now — where do they think they’ll find 400?” Ms. Glazar, the local union official, said shortly before the strike ended. “That’s the only thing that keeps us smiling out there.”There were also indications that Heaven Hill was running low on inventory as the strike wore on, crimping the company’s ability to age and bottle alcohol that it produced in Louisville. “We could see the truck movement had slowed down from week one to week six — there were not near as many trucks in and out,” Ms. Glazar said.Josh Hafer, a company spokesman, said, “There may have been some small-scale products impacted, but not to any large degree.”Still, the workers were under enormous stress. Their health benefits ended when their contract expired, and some workers found their insurance was no longer valid while trying to squeeze in a final doctor’s appointment.And while jobs in the area appeared plentiful, many workers preferred to stay in the whiskey-making business. “I like what I do, I enjoy everything about bourbon,” said Austin Hinshaw, a worker who voted to strike at the Heaven Hill plant. “I have worked at a factory before, and it’s not my thing.” In late October, Mr. Hinshaw accepted a job at a distillery in town where he had been applying for months.A few days earlier, Heaven Hill management had worked out a new agreement with the union. The proposed contract included a commitment to largely maintain the existing overtime pay rules for current workers, though it left open the possibility that future workers would be scheduled on weekends at regular pay, which grated on union members. The company also offered a slightly larger pay increase than it had offered just before the workers’ contract expired in September.In a statement, Heaven Hill pointed to the generous health benefits and increased wages and vacation time in the new contract.The company’s proposal divided the members, many of whom wanted to keep fighting, but more than one-third voted in favor of the contract, the minimum needed to approve it and end the strike.“There are a lot of mixed emotions,” Ms. Glazar said. “Some of them are just disappointed.     Why Paid Family Leave’s Demise This Time Could Fuel It Later

    In failing to secure a benefit with bipartisan appeal, President Biden joins a long line of frustrated politicians. But some Republicans say it could be resurrected on its own.WASHINGTON — In late 2019, with bipartisan backing, including from the iconoclastic Senate Democrat Kyrsten Sinema of Arizona, President Donald J. Trump’s daughter Ivanka hosted a summit at the White House to promote her vision for paid family and medical leave.As with many domestic initiatives of the Trump years, the effort went nowhere, thanks in part to the former president’s lack of interest in legislating. But it also stalled in part because of opposition from Democrats like Senator Kirsten Gillibrand of New York, who saw the plan not as a true federal benefit but as a “payday loan” off future Social Security benefits.Ms. Gillibrand believed she could do much better.Last week was the Democrats’ turn to fail. A 12-week paid family and medical leave program, costing $500 billion over 10 years, was supposed to be a centerpiece of President Biden’s social safety net legislation. But it fell out of his compromise framework, a victim of centrists who objected to its ambition and cost.The demise of the effort, even amid bipartisan interest, in part reflected the polarization surrounding Democrats’ marquee domestic legislation, which Republicans are opposing en masse.Some business groups and G.O.P. proponents of a paid leave program believe that if it had been broken out and negotiated with Republicans, the way a $1 trillion infrastructure package was at Mr. Biden’s urging, it could have survived, and some think it still could resurrected as a bipartisan initiative.They said the problem lay with the Democrats’ decision to put paid family leave in the expansive social policy and climate bill — a multitrillion-dollar package financed by large tax increases on businesses and the wealthy — which they knew that Republicans and mainstream business groups would never support.“In any area that is substantive, when members sit down to actually walk through whether or not we can build good legislation, there are possibilities,” Senator Lisa Murkowski, Republican of Alaska, said. “We’re not being encouraged to work together to solve problems. What we’re being encouraged to do is line up with the team so that we can have the political messaging point.”At least for now, though, the United States is almost certain to remain one of only six countries with no national paid leave.“Fundamentally, to provide paid leave, you have to value women and value their work,” Ms. Gillibrand lamented, “and valuing women and their work is a hard thing for the United States.”The last-minute removal of the paid leave program underscored longstanding questions about how it can be that while 186 other countries have such a program, the United States does not.A rally for paid leave near the White House. She said she had been developing paid family and medical leave legislation for nearly a decade, had sought out numerous Republican and business partners, and had always found the parties too ideologically divided.But the issue driving interest in both parties — bringing more women into the work force and keeping them there — has only grown more acute since the coronavirus pandemic hit.White House officials say 95 percent of the lowest-wage workers lack any paid leave, and they are predominantly women and people of color. Some five million women lost their jobs during the pandemic, and many of them, struggling with access to child care and bedeviled by intermittent school closures and periodic Covid-19 outbreaks, have opted not to return.Mr. Trump campaigned on the issue and included six weeks of federally paid leave in his budgets, which were ignored by Republican leaders. Congressional Republicans had their own ideas. Legislation introduced in 2019 by Senators Sinema and Bill Cassidy, Republican of Louisiana, and Representatives Elise Stefanik, Republican of New York, and Colin Allred, Democrat of Texas, would offer new parents $5,000 during the first year of their baby’s life, which they would repay over the decade through cuts to their child tax credit.The Republican senators Marco Rubio of Florida, Mitt Romney of Utah, Joni Ernst of Iowa and Mike Lee of Utah similarly proposed offering workers parental leave benefits that would have to be repaid — with interest — through cuts in their Social Security retirement benefits.Senator Deb Fischer, Republican of Nebraska, championed and secured more modest legislation — tucked into the Republican tax cuts of 2017 — that gave small businesses a tax credit to fund family leave. She argued against broader versions, since many companies already offer employees paid leave.“If you have two or three employees, you cannot afford to do paid family leave because you can’t afford to hire somebody to take their place, which is why I think the tax credit that we have in law now is really beneficial,” Ms. Fischer said.According to the White House, fewer than a third of small businesses with 100 or more employees offer paid leave. Only 14 percent with fewer than 50 employees do. Ms. Fischer conceded that few small businesses have taken advantage of her credit, but she blamed the Treasury Department, under Mr. Trump and Mr. Biden, for dragging its feet on issuing detailed regulations and promoting it.To Democrats, those proposals are not true leave. They are either loans off other needed benefits or too limited to make a difference. Ms. Gillibrand said that optimally, a stable, generous family and medical leave plan would be an “earned benefit” like Social Security and Medicare: Workers would pay into the system and claim the benefit when they needed it, regardless of where they worked or how much they earned.But, she said, taxing workers has become politically difficult. Her 2013 bill envisioned family and medical leave insurance, financed by a small contribution from employers with each paycheck.This year, the Biden administration and Democratic leaders opted to fund paid leave out of general revenues, bolstered by tax increases on the wealthy and corporations. They said the program was part of a broader “human infrastructure” effort to help children and young parents, which included child care support, a child tax credit and universal prekindergarten — and therefore didn’t need a dedicated funding source.Senator Joe Manchin III, Democrat of West Virginia, opposed a plan for 12 weeks of paid family and medical leave, saying he worried that without a stable revenue source, it would be a drain on the Social Security system.Al Drago for The New York TimesThe House proposal would have guaranteed 12 weeks of paid family and medical leave annually to all workers, in private or government employment, gig work like Uber and Lyft, or self-employment. The benefit would have replaced 85 percent of wages or earnings for the lowest-paid workers, scaling back from there.That generosity was why the plan ran into a roadblock in the Senate. Senator Joe Manchin III, Democrat of West Virginia, saw an expensive new benefit without a stable revenue source that he worried would end up draining an already stressed Social Security system.Ms. Gillibrand and Senator Patty Murray, Democrat of Washington, have pleaded, cajoled and bargained with him. They said a paid leave plan would actually bolster Social Security’s finances by helping women get back to work, where they would pay Social Security taxes, and helping young families have more children, which would bolster the work force of the future. Democrats offered to scale back a 12-week leave plan to four weeks, then to limit it to leave for new babies, not medical emergencies.Mr. Manchin promised to consider the offers, but few are optimistic. Ms. Gillibrand sees societal issues at work. While it is true that virtually every country in the world has a paid leave program, that is somewhat misleading, she said.Most of those countries can afford to offer paid leave because they do not actually expect women to work once they begin having children. Long leave plans help couples get started having children, but most countries then do not help with child care because they assume women will stay home.The U.S. work force relies on women. Mr. Biden’s compromise framework does include generous subsidies for child care starting at birth and for universal prekindergarten for 3- and 4-year-olds. It now lacks the first step: helping parents through pregnancy and childbirth.“What we’re trying to achieve here is the ability of women to work effectively and to be most productive at work,” Ms. Gillibrand said.Advocates say lawmakers should not give up yet. Marc Freedman, the U.S. Chamber of Commerce’s vice president for employment policy, said the business group had been meeting with congressional offices before the pandemic, pressing for a national paid leave plan to replace the patchwork of state and local government plans popping up.The government would create a minimum benefit that businesses would be allowed to exceed for recruitment and retention, financed by a payroll tax paid by employees. Such a plan would help smaller businesses compete for labor with larger corporations, while offloading some of the burden on companies that already offer leave plans.“We very much want to restart those conversations,” he said.Some Republicans, especially Republican women, say they are ready to join those talks.“It’s an issue we need to address as a nation and look at and get creative with,” said Senator Shelley Moore Capito, Republican of West Virginia, who helped secure paid leave for federal workers.But as with the infrastructure deal struck over the summer, Democrats would not be likely to get all they want. Ms. Capito, for instance, said the plan that Mr. Manchin killed was too generous, with leave beyond care for new babies and sick family members.Ms. Gillibrand said she had already begun outreach. She talked to Senator Susan Collins, Republican of Maine, about an interim step of helping small states pool with larger ones to create regional leave programs. She signaled flexibility on funding the kind of insurance mechanism that Mr. Freedman said the Chamber of Commerce favored.But none of those ideas would happen as quickly as the broad program that Mr. Manchin is opposing, she said.“There is work I can do over the next six months to a year, sure, but will take time,” Ms. Gillibrand concluded. “And it won’t be simple.” More
